This contract sha1.~ be effective 6eeween .l'uly 1; 1972, and June 30, 1973. 1. Services to be performed by th~ CouuL'y, together with payments for and conditions of sesvice, are listed on attachment "A" to this contract, ~ which doc~uner_C is made a part of this contract. Campensation to the County for its services is provided in attachment ",A", Part III(a). 2. The County sha11 maintain t3me slips for each inspector on a daiZy basis showing the number of hours spent by each man performing services under th3s contxact kogether with.copies oE official certi£icates as specffied by the Director and any other records as requfred givfng a sununary of work performed. 3. The County, on a quarterly basis, shall submit to tihe Director an invoice for the wark performed ahowing the amounY of salaries based upon the numher of hours wnrked as agreed upon and a separaCe amounC for expenses Co be siiowed such as mileage and other necessities required fn Che inspecCion work. 4. No alteration or modi.fication of this agreeMent is valid unless made in writing and assented to in the same manner as this agreement. 5. This agreemene maq be canceled by either party upon thirty (30) days written notice or u~;on termination of fund~.ng by the i3nited States Department of Agriculture~ Should the eontxact be terminated prior to ,lttine 30, 1973 , payment shall be made for work performed up to the effective date of teFmination. In the performance of th3s contracr., the State shall be reaponsible fnr any liability resulting from the negligene or wrongful acts or omissians of its officers, agents, and employees, and the County sha3.3. be responsible for any liability rasult3ag from the negligent or wrongful acts or omissions o~ its officers, agents, and employees. ATTACHMENT A if~THOD OF PROCEDURE FOR ENRORCEMEN'~ OF CALIFORNIA STATE DEPARTMENT OF AGRICiTL~URE EGG STANDARDS PART I ~ The State - (a) through the State Supervising Inspector will assume responsi- bil3ty for coordinating the training and supervision of inspectors, interpretation and appllcaCion of grades~, and methods of making inspections. (b) will fuanish the standard inspector's notes now in use under similar cooperative agreements with the various count3es; provided, t~at addiCional printing which is agreed upon by both parties to be necessary to the work under this agreement may be done by the county and ttee cost of such printing sha~.I be creditied Co the county in the quarterly billing to the Srate. PAlt'~ II The County Department of Agriculture - (a) will keep a separate and comp7.ete accounting of all rece3pts or expenditures of mon3es and all time slips ~or the work done under this agreement, and the State Department of Agriculture shall have an opportunity to audit these records periodically. The audit shall cover the terms and p.rovisions of this agree- ment and the report shall contain a statement of financial condition. These records shall be accessfble to the State Supervising Inspectors at all tiimes. A1Z such receipts, time slips, and other records as required by the Director shall be maintained and kept by tihe county uneil audited. However, in no case, even though not audited, shall the county be requ~.red to mainCafn any records £or a period to exceed five (5) years. (b) wi11 pay an hourly rate and any necessarp e~enses for the time 3nspectors ase employed to work under this agreement. (c) wi11 furnish the necessary inspection equipment, transpor- tation, office space, expenses and supplles, and clerical help for carrying on the inspection work under this agreement. PART III Mutual Agreements - It is mutually understood and agreed that - (a) the Director and Co~-issioners agree that ~he hourly rate to be paid to the county is $ 5.00 This rate is the total payment to the county for salaries, staff benef3.ts and any other overhead charges. 5/72 emmerur~Nm e METHOD OF PROCEllURE FC1R C~RTIFICATION AND SURVEILLANCE OF EGGS TO U. S. STANDARDS PART I The State - (a) thmugh the State Supervising inspector will assume responsibi- litp for coordinating the training and supervision of fnspectors, 3nterpreCation and application o~ grades, methods of making inspections, and cesti~ticate writing. (b) through the Federal Supervisfng Tnspector wi3.i issue Federal licenses to such quaJ.~fied inspectors as may be employed by the county Department of Agriculture for work to be done under their agreement that requires a Federal license. (c) wi3.1 furnish the standard inspector's notes and certificate foT'm3 now in use under similar cooperative agreements with the various count3es; provfded, that additional printing which is agreed upon by botlt parties to be necessary to the work under this agreement may be done by the county and the cost of such printing sha11 be credited to the couney in the quarterly billing Co the SCate. Agreements - It is mutually understoad and agreed that - (a) the Dixector and Cowmissioners agxee that the hourly rate to be paid to the county is as follows: for surveillance $ 6.00 per houx; fox certification $ 6.00 per hour. This rate is Che total payment to the county for salaries, staff benefits and any other overhead charges. In addition, the county may claim mileage for necessary travel at applicable State Board of Control rates. (b) all licensed inspectors sha11 adhere to current regulations in 7 CFR, Part 56 - Grading of Shell Eggs and United State Standards, Grades, and Weight Classes for Shell Eggs. Said xegulations are incorporated in this agreement by reference. (c) the total amouat o~ this aontract shall nat exceed $ 7~0.00 (d) the app~opriate Fedexal ox State Supervisoxs wi11 have the ri~ht to eater any connty at any time where work is being done under this agreement to observe the actual inspection of eggs. (e) State and county personnel wi11 keep each other ~.nformed on all activities pertaining to inspections made pursuant to this agreement. 4/21/72
