WfiIItEAS, The County of Butte h.as traffic signals i.zistalled at
various locations in the County; and
WHFRFAS, The Gounty does no~ have adequate personneJ. or equipment
fox the ma~ntenance of such traf£ic signals;
NOW, TH~R.EF'ORE, BE IT RESOLVED that the State of California, Divis~.on
of Highways, be requested to maintain said sign.al system at an est9mated cost
of ~1,400.00 for the 1972-73 f~.scal year.
BE IT FURTIiER.RESOLVED that the following °1Save Harmless" provision
is approved by ~he Board in connection with such maintenance:
~~It is expressiy understood and agreed by the Gounty that the
S`tate o£ Cal~ornza and it s of£icers and its employees shall
not be answerable or accountable in any manner for injuries
to or the &eath of persons or for any damage to property xe-
sulting from the opexation of or the £a~.].ure to maintain the
traffic signals."
"T~e County agrees to indemnify and save harmless the State of.
California and its officers and employees from al.l. sui~ts,
actions or claim.s of any character bxought as a consequence ,
of the opera~ion o~ or the failure to maintain the traffic
signals."
BE IT FCTRTHER RESO~,VED tha~ the Cou.nty will deposit su£ficient f'unds
not to exceed ~~-,4~~0.00 with the Division of Highways for the mai.ntenance of said
signa7~s dvsi.ng the 1972-73 fzscal year.
