Butte approves the attached Agreement between the Chi.co
Community Memorial Hospital and the County of Butte and hereby
authorizes the Director of the ~utte County Menta'~ Health
Services, Dr. Gerald E. Maguire, to execute said Agreement an
behalf of the County of Butte.

THIS AGI~EEMENT is made and executed in duplicate at
Chico~ California as o~ ~a~Pmber_~ __~___, 7-972~ by and
between Chico COMMUNITY MEMORIAL HOSP~TAL, a who~.ly-owned sub-
sidia~y of NATI~ONAL MEDICA~, ENTBRPRISES, INC,~ a California
corporation, herei.nafter.designated as "Chico"y.and BUTTE COUNT`Y
MENTAL HEALTH SERVICES, ~ereina~ter designated as "Butte",
• W I T N E S S E T H: -
WHEREAS, Chico is the ow,ner and ope~ator of a hospital
located at 560 Cohasset Road, Chico,,Califo~nia, hereinafter
designated as "hospital", and
• WHER.~AS, Butte is an agency organized and operated by
the County of Butte to provide and ensure adequate medical care
far psychiatric pa~ients in said county; and
WHEREAS, Butte needs a~u11 service hospital in said
county to provide beds and medical services for said patients,
NOW, THEREFORE, for and in consideration o~ the promises~
mutual cavenants and agreements herein contained, it is under-
stood and agreed by and between the parties hereto as follows:
FIRST: Chico shall at a11 times keep available
a section or sec~io ns ot the Hospital contaa.ning semi-private
bed units for any and all patients considered by Butte to be in
need of hospitalization pritnarily for mental disorders. Within
said section or sections, Chico shall provide a room for patient
activity programs and group meetings.
SECOND: The parties hereto mutually agree and
understand that the Hospital is to be designated by the Butte

County Board of Supervisors as a hospital fac9.7.ity in Butte County
that shall provide psychiatric hospitalizatian, care and treatment
of psychzatric patients in said countyo Therefore, Butte agrees
to refer a11 appropriate psychiatric patients in said county
requiring hospitalization ~o the Hospitalo
THIRD: I, Chxco sha11 provide and maintain a
ful~.-ti~ae nursin~. staff, for the care and treatment of psychiatric
pat~ents admitted,to the Haspital, Said staf£ sha11 meet the
minimum standards set forth in the Regulations for Cofnmuni~y
Men~a1 HeaZth Services Und.er the Short-Doyle Act. In addi~.ion,
Chicv shall select and maintain an "on-ca1L" roster of nurses
and other.nursing personnel, for special duty nursing of psychiatric
patients. Said roster shall be availabl.e at al1 times„for use by
Butte's psychiatrists,

maintain and employ a staff of licensed psychiatris~s, who sr~a~l
be available seven (7) days a week or provide collaborative
treatment, care and consultation to patients admitted to Hospital
with ,'~primary" psychiatric illnesses, The deca.sion tliat a
patient is hospitalized pritnarily for psychiatric illness will
be made by the admitting physician, subject to the appraval of
the Di.rector of the County Mental Health Services or his designeeo
Said approv.al shall be obtained prior to the admissivn of any
such patient to the Hospital,

the other party of any term, covenant or condition of this
Agreemen~, o~her tlzan the failure ot that party to perform ~he
partzcular dutfes so accepted, regardless of knowledge of such
preceda.ng breach at the tic~e of acceptance of such performance.
. ELEV~NTH: Any and all notices required to be
given pursuant to,the terms of this Agreement may be given

Butte at the ~ollowing addresses.: . ~

TW~FTH: Notwithstanding any provision to the
contrary, this Agreement will not be effective until such tirne as
the Butte County Board o~ Supervisors adopts a budget appropriation
to cover the cost of services to be provided and until such time
as the Agreement is approved by the Director of the California
State Departmen~ of Mental Hygiene.
IN WITNESS WHEREOF, Chico and Butte have executed this
Agreement by hereunto setting their hands as of the day and year
