HomeMy WebLinkAbout72-128WHERE[~„S, self-sufficiency and independence are greatly admired and long-standing American characterists, and WHEREAS, the concept o~' Home RuI.e embodies said basic American characteristics in fihe governance of local communities, and WHEREAS, the County of Butte has long cherished its tradition of Home Rule, adopting a Charter in 1917, and WHER~AS, the County of Butte is a Chartered California County, which Charter has been amended from time to time to accommodate changing valaes and county gror~rth, and WHEREAS, the citizens o~ the County of Butte believe they are, and indeed are, best suited to determa.ne tne rules and ordinances required tor the governance of tl~eir county, and WFiEREAS, the citizens of the County of Butte have been proud to assume responsibility for the promulgation of rules and ordinances related to matters of local concern in the best Ameri,can tradition, and WHEREAS, the Board of Supervisors of the County of Butte recognizes its relationship to the Legislature o~ the State of California, and deters to the State the right to establish laws e~fecting counties when such laws meet the test o~ .Absolute Need for Uniformity and, in fact, become uni~orm standards for all government agencies throughout the State, and WHEREAS, the Board of Supervisors of the County of Butte has been alarmed over the past several. years to witness the Legislature of the State af California consider and approve bills RESOLUTION OUTLINING THE POLICY OF THE COUNTY OF BiTTTE REGARDING THE ENCROACHN~NT OF THE STATE LEGTSLATURE INTO HOME RULE MATTERS which effectively invade the accepted limits of local control and remove responsibility from local officials and the citizens of the counties, thereby eroding the concept of Home Rule and.denying the citizens of counties the dignity and pride inherent therein, ' some of which matters of local concern are hereinafter recited: ONE: A~1 matters relating to wages, hours, fringe benef~ts (including retirement programs) and working conditions of county employees, excepting there~rom such matters as Workmen's Compensation and Unemployment Insurance benefits, which are legitimate matters of statewide concern for the State Legislature, snd TWO: Caunty planning, including the requirements for Genera~ Plans and all elements thereto, and THREE: Restrictions related to the development of '' new revenue sources by eounties, which restrictions force counties to inerease property taxes thereby placing an onerous burden upon local property taxpayers, and FOUR: Restrictions placed upon the use of State sub- ventions, which subventions are taxes collected by the State for use by local agencies oniy because the State is a more efficient collector of such taxes and not because the State is better equipped to determine said uses, and FIVE: The increasing tendency for the State to develop new sources of State revenue, which revenue must be collected by the local agencies, and, in effect, require said local agencies to expend ~oca~ revenue in the collection thereof without compensa-` tio~, and SEVEDI: The propensity of the State Legislatu~e to enact legislation mandating counties to meet cer~ain expensive and restrictive standards (especially with regard to personnel), which legislation specifically exempts the agencies of the State o~ California from meeting the same standards, and 2. _ __ : . , . ~I ~ ,.~ : WHEREAS, the Board of Supervisors of the County of Butte has always communicated its position to the Legislature of the State of California ~egarding legislation affecting local agencies, but has never effectively informed its citizenry of the gravity of such legislation, and W~iEREAS, the Board of Supervisors of the County of But~e believes that by adopting this resolution, the citizens of the County of Butte will be informed of this grave situation, and WHEREAS, the citizens of the County o£ Sutte are represented in the California State Legislature by Senator Fred Mar~er and Assemblyman Ray Johnson, both of whom are aware o~ the Board's concern, and who, in the past, have supported the principles enunciated above; NOW, THEREFORE, BE IT RESOLVED by the Board of 5uper- visors of the County of Bu~~te as follows, to wit: 1. 'That the Soard of Supervisors of the County of Butte wishes to reinforce its objection to such legislation herein- before recited, and hereby does strenuously object to the zncursion of the State Legislature into areas that have been traditionally and rightfully matters of local concern, which matters fa11 withi~n the purviaw of Home RuI.e: 2. That copies of this resolutian be transmftted to Senator Fred IrFarler and Assemblyman Ray Johnson, with the urging of the Board of Supervisors of the County of Butte that these representatives continue to give careful consideration to the effect state legislation may have on the operatian of local government, and especially as such state 1.egislat~m may affect long-established basic principles xelated to the governance of 1oca1 agencies. 3. That the County Clerk be directed to send copies of this resolutxon to the news media, other interested legislators, and any other parties the Board of Supervisors of the County of Butte may from time to time find it necessary to inform or remind of tne 3. position of the Board of _Supervisors of the County of Butte as it relates to matters hereinbefore set forth. PASSED AND ADOPTED by the Butte County Board of Supervisors this 25th_ day of ~_ Ju~___~__, 1972, by the follow- ing vote: AYES: Superuisars Dou~hit, Ladd, Madigan, Maxon and Chairman Gilman.
