Resolution ~stablishing Skyway
Underground Utility District No. 1
BE IT RESOLVED by Che Board of Supervisors of Che County of Butte as
follows:
WHEREAS, by resolution dated August 15, 1972, a public hearing was called
for on September 19, 1972 at the hour o£ 1:30 P,?~!. in the Board of Supervisors
Room in. the Courthouse, Oroville, California, to ascertain whether the public
rcecessity, health, safety or welfare requires the removal of poles, overhead
wires and associated overhead struckures, and ttae uttdergxound installation of
wires and facilities for su~pplying electric, communication ox si.mi.lar ox
associated service, within that certain area of the county descri.bed as £ollows:
On the Skyway from Jewell Road (Skyway Engineer's Station 633+79.35) to Lucky
7ohn Road (Skyway Engineer's Station 707+69.56) and bounded by a line 150 feet
each side of the centerline o£ SEcyway~ and,
WHEREAS~ notice o£ such heaxing has been given to all affected properCy
owners as such are shown on. the J.ast equalized assessment roll and to aii
uCilities concerned in the mannex and within the time required by ~.aw; and
4dHEREAfi, such hearing has been duly and regularly held, and all persons
interested have been given an opportunity to be heard,
NOW~ THEI2EFORE~ BE IT RESOLVED by tihe Board of Supervisors of the County
of Butte~ that, parsuant to Ordinance No. 981 of the County of Sutte and all
amendments thereto~ the above-described area i.s hereby declared an Undergrovnd
Uti7.a.ty District, and is designated as Skyway.Underground Ut3.7.ity Distric~ No. 1
o£ the County of BuCte. ACtached hereto and hereby incorporated as a part of
th3.s resolution is a map deiineating the boundaries of said diserict;

and the underground installation of wires an.d faca.l.i.ties far supplying eleceric,
communication ar similar or associated service within Skyway Underground Uti].ity
District No. 1 on or before September l., 1973 __;
RESOLVED, FURTHER, that the County Clerk is hereby instructed to notify
all affected utilities and aI1, persons owning real property within Skyway
Un.derground Utility Aistrict No. 1 of the adoptiion of this resolution within
ten (10) days a~ter the date of such adopCion. Said County Glerk shall €urther
notify sazd property owners of tFie necessitq that, if they or any person
occupying such pxoperty de~ire to conCinue to xeceive electric, communication~
~or other simi~.ar or associa~ed service, they or such occupant sha17., by the
date fixed in Chis resolution, provide all necessary faciJ.it~ changes on their
premises so as to receive such services from the 7.ines of the supplying utiLiCy
or uCilities at a new location, subject ~o applicabJ.e rules~ regulations, and
tariffs of the respective utility or utilities on ~i.le with the Public Utilities
Commission of Che State o£ California. Such noti£ication shaZl be made by
mailing a copy of Chis reso3.ution togettter with a copy of said Ordinance No.
981 and all ainendments thereto, to a11 a~fected property owners as such are
shown on Che last equalized assessment roiJ, and to the affec~Ced utilities;
RE56I,VED~ FURTHER, that the Board o~ Supexvisors hereby finds and
determines as follows:
The Underground Utility District herein created is in the general pulslic
interest for Che following reasonsa
(1) "The undergrounding to be accomplished will avoid or elimina~e
an unusual7.y heavy concentratzon of overhead distribuCion
~aci~ities;"
(2) "The streets, xoads, or rights of way in the Bistxi.ct are

extensively used by the genera~ public and carry a heavy
volutae of pedestr~an or vehicular traffic;"
(3) "The said streets, roads~ or rights o£ way adjoin or pass
through a cfvic area," _
