BE IT RESOLVED by the $OARD OF SUPERVISORS of the County of Butte~
State of California, that said Board finds and determines and hexeby declares,
as fiollows, to wit:
1. That public interest and necessity require the acqui.sition~
constxucti.on and cotnpletion by the County of Butte, of a public improvement9
namely a County Highway known as Ord Fer~'y Ttoad~ in the County of Butfe? State
o~ Califarnia.

3. Said proposed public improvemenC is planned and located in a

4~. Tha~ the County Counsel of the County o£ Butte, is hereby author
empowered as ~ollows:
(a) To acquire~ i.n the name of ~he County of Butte, a fee simple
estate ax sach necessary interests in and to the hereinafter described real
~property~ or interest zn ~ea7. p~operty, and all improvements thereon by condem-
nati.on i~ accordance with the provisions of the Streets and Highways Code, Code
of Civil Procedure and t€~e Constitution o£ the State of Ca~.iforzzia, rela~ing to
eminent domain~ to authorize the auditor to pay from County ~unds the costs and
consideration for said acquistion~ and the auditor is authorized to make such
payment on authorization.

(b) To prepare and prosecute for the County of Butte such pro-
ceedings in ~he proper;_court having jurisdiction thereof, and make such de-
posits from County funds for £ees and costs as are necessary for such acquisitio
(c) To make application to said court for an order fixing the amount
o~ security in ~he way of moneys deposited as said court may direct, and for
an order permitting the County of Butte to take immediate possessfon and use of
sa~d zea~ pxoperty, or interesta, or improvements in said real property, as a ri
of way fox a public highway £ox pub~ic useo
(d) ~o make deposit of such security Qut of proper funds under the
control of the County o~ Butte, in such amounts as fixed and determined and. in
such manner as said couxt in which condemnat~on pxoceedings are pending may
direct~ and t~e Auditor is aufhorized to make saxd deposzt zmmediately upon the
court making said ordex.
