HomeMy WebLinkAbout72911 2 3 4 5 6 7 8 9 la ~i 3.1 12 13 I4 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 BUTTE COUNTY ORDINANCE NO. ,729 AN ORDINANCE TO ESTABLISH A PERSONNEL SYSTEM; TO REGULATE THE METHOD OF APPOINTMENT, PROMOTION AND RETENTION OF EMPLOYEES ON THE BASIS OF MERIT AND TO PROVIDE FOR THE ADMINISTRATION OF THE PERSONNEL MERIT SYSTEM. The Board of Supervisors of the County of Butte, State of California, do ordain as follows: 1. TITLE. This ordinance shall be known and may be cited as the "Merit system ordinance of the County of Butte _" 2. PURPOSE. The purpose of this ordinance is to regulate the method of. appointment of persons in the employ of the County of Butte as provided by Section-25300 of the Government ,Code, State of California, and by Article III of the Charter of the County of Butte, by the establishment of a personnel merit system to the end that persons shall be appointed, promoted and retained on the basis of merit. 3. PERSONNEL, RULES. The Bozrd of Supervisors, upon the passage of this ordinance, shall aaopt a resolution setting forth the rules for the administration of the merit system. 4. ADMINISTRATION. A Personnel Director shall be appointed. He will be responsible for the administration of the merit system. A department head may appeal an action of the Personnel Office to the Board of Supervisors_ The Personnel Director shall have authority to appoint such,-employees for personnel work as may be allowed in the budget and in the salary ordinance. He shall provide the Board of Supervisors with such reports and information as the Board may require and shall establish methods and procedures necessary for the proper functioning of the merit system in an efficient and economical (manner. 5. CLASSII'ICATION OF POSITIONS. A11 positions, except those held by elective officers, shall be included in a class- ification plan and shall be classified according to duties and -1-~ 7 ~' I i~ 1 responsibilities in such a way that schedules of compensation may 2 be applied equitably, The number of positions allocated to the 3 various classes of the classification plan shall be set forth 4 in a salary ordinance, Each class shall have a written S specification defining the class, describing the duties and g typical tasks related to the position in the class, and setting ry forth qualifications required of persons appointed to positions g in the class. The concept of position classification applies g to the particular work being performed as described in the class 10 specification and does not apply to the employee holding the 11 position, except that an employee may be designated as having 12 the title of the position for the purpose of identifya,ng him, l3 6. COMPENSATION. A11 classes of positions in the 14 classification plan shall be assigned a sa7.ary range or rate 15 as provided for by a salary ordinance. Employees appointed to 16 positions in the classification plan shall be paid a salary l7 within the monthly range or rate so provided for in the. salary 18 ordinance and according to the procedures established by the 19 Personnel Resolution. 20 7o APPOINTMENTS.. All appointments to administrative 21 positions shall be made by the Board of Supervisors unless 22 otherwise provided by law. All other appointments to positions 23 in the classified service shall be made by department .heads as 24 provided by the Personnel Resolution.. A department head shall 25 appoint only froze among those persons certified to him by the' 26 Personnel Office as being qualified for appointment to a particular 27 class of positionb except that elective officers may, upon 28 approval by the Board of Supervisors, be entitled to have one 2g position exempt from this requirement. Appointments shall be 30 made in writing on farms prescribed by the Personnel Office. 31 The Personnel Office shall, before approving any appointment, 32 determine that there is a vacancy in an authorized position as -2- i 1 allocated in the salary ordinance, that the work to be performed 2 relates to the concept of the position as described in the class 3 specification, and that the appointee is qualified. A copy of ¢ the approved appointment shall be delivered to the Auditor 5 before payment shall be made to any employee accupying a position 6 in the classified service. ry 8. STATUS OF EMPLOXEES. Appointive department heads 8 shall hold their positions for a term of office as provided by 9 law or at the pleasure of the Board of Supervisors, as the case 10 may be, as set forth in the Personnel Resolution. Except for 11 an employee holding an exempt position as described in Section 7, 12 any other employee appointed to a position in the classified 13 service who successfully completes a probationary period of six 14 months following his appointment shall have regular status. An 15 employee who has regular status, who is promoted to a more 16 responsible position and who successfully completes a probationary 17 period of six months in the new position shall have regular 18 status in the new position„ The status of Welfare Aepartment 19 employees shall be as provided by the Personnel Resolution and by 20 the rules of the Welfare Merit System of the.State of California. 21 9. MERIT ADVANCEMENT. An employee shall receive a 22 merit advancement provided he earns it by satisfactory performance 23 according to the provisions of the Personnel Resolution. 2¢ l0. DISCHARGE. An employee may be discharged only 25 for reasonable cause. When a department head believes reasonable 26 cause exists, he shall give the employee a written notice of 27 discharge, specifying reason or reasons for discharge. 28 11. APPEAL COMMISSION. At the beginning of each 29 fiscal year, the Board of Supervisors shall appoint an appeal 30 commission consisting of three persons to hear any appeal from 31 discharge which may be made by an employee who has regular status. 32 When an appeal is made, the commission shall conduct a hearing. -3- 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 2S 26 27 28 29 30 31 32 At the conclusion of the hearing, the commission shall make an official finding. as to whether or not the employee was discharged for reasonable caused The appeal commission may make any (appropriate recommendation it deems advisable. The commission's finding shall be a matter of public record. Any action of the appeal commission shall be final and not subject to judicial review , 12. SERVICESo The Personnel Office shall provide such personnel services and assistance to department heads and employees that will contribute to efficient conduct of the County's business and to the morale of the county employees, 13, RECORDS. The Personnel Office shall maintain such records which are necessary for the effective administration of the personnel program, including a file for each employee which will be available to the employee and authorized persons at all reasonable tixneso Any record kept by the Personnel Office may be destroyed as provided by law. This Ordinance shall take effect thirty {30) days after its passage, and before the expiration of fifteen {15) days after its passage, it shall be published with the names of the members voting for .and against the same, once in a local newspaper published in the County of Butte, State of California.
