~t.ESOLU2'ION ANNE~CING CERT.AIN PROPERTY
TO COUNTY SERVICE AREA I~. 2~
WHEREAS, this Board has been requested by Mr. John 1Jrake to annex the
following described propert~ to County Service Area No. 23 for the purpose of
allowing drainage therefrom to flow into County 5ervice Area No. 23 drainage
facili~ies~ and;
WHEREAS, said drainage facilities were originally constructed by
assessment distric~ proceedings, and;
Wc~REAS, the Local Agency k'ormation Commission of ~he County of Sutte
has approved said annexation prov~.ded th,at the property owners pay into the
Service Area Maintenance Fund an amount equal to what their assessment would
have been had the property been part of the assessment district at the time
of ~.ts formation~ and;
WHEREAS, said Commission has authorized this Board to annex said
property withotz~further notice~ hearing or election.
NOW, THEREFORE BE I~ RESOT,VED by this Hoard as follows: that the
foll.owing property to be annexed is hereby annexed to County Service Area No. 23:
A portion of Lots 3$ and 39, according to tha~ certain Map enti~led~
~~HOBART SUBDIVISION OF THE DANIEL BTDWET~L RA,NCHO~~~ which Map was
recorded in the office of the Recorder of the County of Butte~ State
of Cal.iforn-i.a, on Vovember 7, 190l~ in Book /~ of Maps, at page 24~
anfl more partic~,tlarly described as follows:
Beginning at the most Northerl.y corner of said Lot 3$~ wY~i.ch point
lies in the cen~erline o£ Lassen Avenue; thence South 3~° 0~,' East
/~,.1.7,23 feet along the Northeasterly 1.ine of said Lot 3$ to a, point
on the Westerly line of that certain parcel of land as described in
~Ghat cextazn Deed executed by Rachel Annett Reed~ a widow, to the
City~ of Chico~ a municipal corporation dated May 18~ 19L~.2 and re-
corded June 12, 1942 ~n Vol~e 300 of Ofificial Records o~' Butte
County~ at page 1L~0; thence South 15° 52` West~ /j.71.9b feet along said
line and its e~ension; thence North 38° 0!~' West 695.08 feet to a
poa.nt on the Nor~hwesterly line of said Lo~ 3g and the centerline of
said Lassen Avenue; tnerice North 5~° 56' East 3~7-.50 feet along said
Northwesterly line of Lot 38 and said centerline of Lassen Avenue,
to the point of beginning.
BE ZT FURTHER RESOLVED tha~~ as a condition to said annexation~ the
owners of the above-described property shall pay in~o ~he Service Area Maintenance
Fiuid an amount equal to what their assessment would have been had the property
been part of the assessment district at the time o~ zts formatzon.
