RESQLUTION APPROVING CONTRACT AND AUTHORIZIIV'G
GHAIRMAN OF THE Bi3TTE COUNTY BOAR- OF SUPERVISORS
TO EXECUTE ON BEHALF OF THE COUNTY OF BUTTE
BE IT RESOLVED, that the Board of Supervisors of the
County of Butte l-aereby approves the attached contract between tihe
County ofi Butte and the State of California and hereby authorizes
the Cha~rman of this Board to execute same on behalf of the
Coun~y o~ Butte.
PASSEB AND ADOPTED by the ButCe County Board of
Supervisors this 2~~~ day of February, i973, by the following
vote:

TERMINATIGN OF AGREEMEHT
I THIS TERMINATiON ~F AGREEMEN'T, made and entered into this lst day
~of March, 1973. by and between the 5tate o# Lalifornia acting through
Ithe DeparYment of Navigation and Ocean Development, hereinafter referr

Ito as "STATE", and the County of Butte, hereinafter referred to as
~"APPLICANT";

WHEREAS, nn the lgth day of May, 1g69, APPLICR~IT entered into an
agreement with STAT~, seid agreement re€erred to hereinafter as
"PREVIOUS AGREEMEN7", wherein STATE agreed to grent to APPLICANT the
sum of ONE Hl1NDRED 51XTY 7HOUSAND DOLLARS for tfie purpose of designing,
constructing, operating and maintaining boat launcMing facilities at
Lime Saddle. Oroville State Recrea[ion Area; and
WHEREAS, the boat launching fat+laties to be provided under said
PREVIOUS A6REEMEN7 are now completed and in pu6lic use; and
WNER~AS, the real property upon wh~ch said boat launthing facil-
ities are constructed is owned by the State Department of Rarks and
Recreation, and is leased to APPLICAN"f under an:agreement between
Parks and Recreation and APPLICANT dated July 1~ 1969; and
WHEREAS~ ii has always been clearly understood by STATE,
APPLICANT, and Parks and Recreation that eve~tually Parks and Recre-
ation would assume full responsibility for the operatioo ard maiote-
rsance of the boat launching facilities at Lime Saddte; aod
4lyEi~EAS, Parks and Recreation has officially notified APPLICANT
that it will in fact assume full responsibility for tE~e maintenance
and operation of the boat launct~i~g facilities at Lime Saddle,
effective the Ist day of March. 1973; and

WHEREAS, STATE concurrs in said transfer; and
WHEREAS, all funds provided under saPd PREVIOUS AGRE~MENT have
been exper,ded;
NOW, THEREFORE, in consideration of tF~e mutual promises and
Icovenants hereinafter contained, the parties hereto hereby agree as
~Ifoliows:
I 1. Thet said PREVIOt1S AGREEMEN7 will be terminated on the lst
~ day of M~arch, 1973.
2. That APPLICANT will, prior Yo the lst day of May. t973,
Iprepare and forward to STATE a Lime Saddle Termination Report which
'shall inciude but not be limited to the following:
(a) Maintenance and operational status of project.
(b) Financial sCatement showing revenues and mainte-
nance expenditures #rom May 19, 1g59 to Marcfi l,
1973. .
(c) Visitor data re#lecting the estimated number of
boats launched at Lime Saddle weekiy~ monthiy,
and seasonaliy during the ig71 and 1972 summer
boating seasons.
3, That alt books, records and accounts kept by APPLICANT
I!~ relative to the desigrt, construction and operation of the boat lau~ch-

II ing facilities at Lime Saddle shall remain ope~ and available at all
reasonable times for audit and inspection by any duty authnrized
officer of STATE.
