CHA2RMAN OF 'I'I-IE BOARD OF SUPERVISORS TQ ~XECUTE
ON BEt31~.F OF THE COUNTY OF BUTTE
BE IT RESOZVED that the Board of 5ugervisors of the Cottnty
of Butte hereby approves the attached assignmen~ between the
Covnty of Butte and the State of California through i~s Department
of Farks and Recreation and hereby authorizes the Chairman o~ this
Board to execute same on behalf of the County of Butte,
PASSED AND ADOPTED by the Butte County Board of ~Supexvisors
this 27th day of , 1973, by the follosaing vote:
AYES: Supervisors Cameron, Gilman, I,add, Madigan and Chairman McKillo

A S S I G N M E N T
WHEREAS, the County of Sutte and California Communi~y
Developers~ Inc, entered into a Concession Agreement in 1969, and
WI3ERF~S, the Department of Parks and Recreation a~ the
Sfiate of Califarnia duly appraved said Concession Agre~nent with
the addition o~ certain restrictions as set forth in their letter
of August ~2, 1969, and identified as Exhibit "4'~ to the a~oresaid
Concession Agreelnent, and
WHEREAS, pursuant to the operating agreement between the
Department o~' Parks and Recx~eation and the County of But~e dated
July 1, 1969, the Sta~e has the option of assuming cantrol of
said recreation areao
NOW, THEREFORE, BE IT AGREEb as fallows:
1, That the County of Butte hereby assigns a11 of its
x'ight, title and interest w~hatsoever in the aforementioxXed Concession
Agreement to the State ot California, said assignment to incl.ude a11
of the righ~.s, privileges, and duties whatsoever, as set forth in
said Concession Agreement to be per~ormed by or for the benefit of
the V ~~~.~y o
2, That upon the effective date of this .Assignment, the
State shall assume all the ob~igations of County under said
Coneession Agreefnent and sk~all hold the County harmless from any
claims by third parties ox' the concessionaire arising directly or
indirectly from said Concessian Agreement, In the event litigation
is brought against the County.relating directly or indirectly to
said Concession Agreement~ State shall supply at no cost ~o County
legal defense to such litigation and State shall pay a11 cost of
suit and any judgment obtained therein against the Coun.ty of Bu~tee
3o The effective date of this Assignment is
1973,
