RESOZUTION AUTfiORIZING CHAIRIVIAN
TO EXECUTE RIGHT OF WAY CERT1~'ICATION N0. 2
ORD ~'ER1LY 1t0AD FAS PROJECT N0. 1523 (4)
IT IS HB7tEBY RESOLVED by the Board of Supexvisors of the Coun.ty of
Sutte, State of California, that Chairman of the Board is hereby authorized
a~td directed to executed Right of Way Certification Noo 2 dated Nfarch 6'
, 1973, £or the Ord Ferry Road FAS Project No, 1523(4) in the
name of the County of Butte.
Be it further resolved that the County of Butte agrees ~o hold the
State of Califomia harmless from any liability which may result in the event
the right of way is not clear as certifiied. T~ th.e State is named in a,damage
suit, as a result o~ the right o~ way not being clear as certi£ied, the Gounty
o~ Butte agrees that, at the request o£ the Sta~e, 9.t will. assume full. respon-
sibility for the conduct of the defense or provide such assistance as the
State may require and wi11 pay any judgments issued againsC the State and aII
costs in connection with the defense.
