REQUEST FOR ALLOCATION OF EUNDS
The County o~ Butte, State of California, hereby requeses the public Utilities'
Commission to make an allocation to applicant from the Crossing Protection Fund in
the maximum amount of $3,097.50, sueh allocation, however, not to exceed one-half
of the actual cost of applicant`s s~are of the costis of cons[ructing crossing pro-
tection at the following crossings:
A. Westezn Pacific Railroad on Georgia Pacific Access Road (Crossing No. 4-203.2C)
S. Western Pacific Railroad on Georgia Pacific Access Road (Crossing No. 4-203.9C)
The total cost of constructing the crossing protection at these two locations was
$20,649.98 of which 70% ($14,454.98) was gaid under an Economic Development Ad~inistration
Grant, xh~s leaves a balance of $6,1R5.00 as applicant`s share o~ cost.
1. Attached as Exhibit "A" is a true copy of a resolution adopted by the Sutte County
Board of Supervisors authorizing submission of this request.
2, Both of these crossings are new.
3. Protection at boCh crossings consists of automatic flashing Iights.
4. Vehicular and train Craffic:
A. Vehicles-~approximately 200 per day.
B. Trains°~two trains in each direction,fiqe days a week.

5. Attached as ExhibiC "B" are bills from WesCern Pacific Railroad covering Che
costs of insta llation of the crossing protection.
6. Attached as Ex~ibit "C" are true copies of Che agreements between applicant
and railroad.
7. The CounCy of BuCCe is willing and able to participate in the costs of con=
struction in tihe amount of $3,b97.50 over and above the amount of the reqaested
allocation and this amounti has been budgeted in the current fiscal year.
8. During the Iast three fiscal years, the County of Butte has expended $32,683.28
for crossing protection. Amount bud~eted for the presen[ fiscal year is $80,000.00
9. Funds for pavement markings and advance warning signs are included in the County's
maintenance budget. These markings and signs were piaced prior to completion of the
new crossing installations.
WI-IEREFORE, applicant requests an appropxiate allocation from the Crossing
ProCection Fund.

RAILR0~1D.CdMPANY, a corporation, hereinafter termed "Railroad"
and the COUNTY OF BUTTE, a po~.itical subdivision of the State
of California, hereinafter termed "County". "
R E C T T A L S:
County proposes to construct.and maintain a new public
grade crossing over the righ't-af-way and tracks of Railroad's
spur track leading to the Georgia-Pacific plant from Railroad's
dri11 track connecting to its maiin track at Mi1e Post 202.768,
said crossing bei.ng identi£ied as Crossing No. 4--2Q3.9C.
The parti.es hereto desire to evidence by,this instrument
the~.r agreement wi~h respeot ta their respective rights and
duties in relation to said crossing.
Tni I T N E S S E T H:
NOW THEREFORE, it is mutually agreed by and be~ween the .
parties hereto as follows, to wit:
1. Railroad, to the extent it has the right and power
to do so, hereby grants County joint use with RaiZroad of that
portion of the raiiroad right-of--way to be occupied by Crossing
No. 4-203.9C, said portion of the right-af-way being more parti-
cularly described on Exhibit "A", at~ached hereto and by reference
incorporated herein.

a. Sai.d grant includes the right of County to enter
upon the property described in said Exhibit "A" and to construct
and maintain said arossing in accordance wa.th pl.ans.and specifi-
cations approved by Railroad.
2, No benefit will acarue to Railroad from ~he construction
of said publia'grade crossing and Coun~p agrees to bear a11 costs
' in connection with the construction and maintenance of said p~blic
grade arossing excep'~ as hereinafter pzovidec3.
3. '~he permission hereby granted to Caunty is subjec~ and
subordinate to the prior and continuing rights and obligations
of Rail.road, its successors anc~ assigns, to use and maintain its
entire railroad right-of-urayr;and property in perfarmance of its
publ.ic du~y as a common carrier in a manner consistent with the
permission hereby granted to Co~nty, and is also subjeot tn the
right of Railroad, its suocessors and assigns, to use the said
property hereinabove described, or any or all.parts thereof, for
a17. purposas which are consistent with the enjoyment of the per-
mission heraby granted to County.
4. In the event any work upon or in connection with the
construction, reconstruction, repair, maintenance~, ogeration or
use of said public,grade crossi.ng is.let to a contractor by
County, 5uch contractor, in advance of ~he pErfarmance of any
such work, sha11 be required (a) to enter into an agreernent wa.th
Railzoad, substantially in the form attached hereta and marked

Exhibit "B", covering the performance thereof and indemnifying.
Railroad from and against all claims, demands, costs, loss,
damage and Ziability growing out of the performance of the
work to be dane by such contractor or any of such contzac'tor's
subcontractors; (b) to furnish withou~ cost to Raiiroad with
respect to the work which such contractor, or any o~ its suh-
contractors may perform for and in behalf of Railroad, insurance
as set foxth in said Exhibit "B".
5. Construction to be performed by Railroad at sole cost
and expense of Coun~y shall include,.but not necessarily be
limited to, the following: • ~
(a) F~reparation ot track structure to receive~ '
paving and insta7.~ation of hardwaod panels in the
crossa.ng area adjacent to the rails, estimated cost
$600.00. .
(b} Installat5.on of au~omatic grade crossing
signals generally known as.cantilever type fl.ashing
lie~hts together with the necessary actuatirsg and
opexating circuits, instruinent housing and,all ~
appurtenanoes ~hereof, estimated cos~. $15,000.00.
6. RaiJ.road agrees that the installation of said automatic
gzade crossing devices shall conform to the usual s~andards of.
Railroad and the recommenfled s~andards of the Association o~
American Railroads and will be.in compliance wa.th General Order

mhe const=uction wark herein grescribed shall be undertaken upon
the availability of materials and labor following nntification to
Railroad's Chief Engineer that funds for County's costs are avail- ~

7. County agrees to pay Railroad the cost of said construc--
~ion and installation ~romptly upon receipt of bills therefor,
said bills to be based on actual cost to Railroad whether more or
less thari estimated cos~ shown in Section 6.
8. Aftez a.nstallation of said crossing has bean completed,
Railroad shall maintain the pav'ing between the raiis and two (2)
fee~ outside thereof at its expense. ~
County agrees that it will maintain said crossing
outside of the area between lines two feet outside of the rails.
9. A~ter installa~ion of said signals has been coinpleted,
Railroad sha11 maintai.n said signaZs so long as the same shall
remain in place. Cost of maintaining said signals and associated
control appa~atus shall be borne by County in accordance with the
provisions of Sec~ions 1202.2 and 1231.1 of ttte California Public
Utilities Coc~e. • ~
10. Coun~y does not assume any liability £or injury or
da~nage to any perso~. or property, inciden.t to nr ~hat. may be sus-
tained as a consequence of the failure of Railroad to properly
construct, main~ai~ and aperate such crossing protective tacilities.

1~., In the even~ of discontinuance of the use of the above
described parcel of real property or any portion thereof for the
purpose provided herein, all rights hereby given shall forthwith
cease and terminate and shall revert ~o Railrnad to the extent of
such abandoned portion or portions.
i2. This agreement shall be binding.upon and inure to the
benefit of the successors and assigns of Railroad.

3, The permission hereby granted to County is subject
and subordinate to the prior and continuing rights and obliga-
tions of Railroad, its successors and assigns, to use and main-
tain its entire railroad righ~~of-way and property in perfozmance
of its public duty as a common carrier in a manner consistent
with the permission hereby g~an~ed to CountX, and is also subje~~
