RESOZUTIOI3 APPROVING AGREEMENT AND AiTTHORIZING
'THE CHAIRMAN OF THE BOARD OF SUPERVISORS TO
EXECUTE OI3 BEEiALF OF TfiE COUNTY OF BUTTE
BE IT RESOLVED, that the Board of Supervisors of the County
of Butte hereby approves the attached agreement between the
Coun~y of Butte and the E'orest Supervisor, Plumas National
Forest and hereby authorizes the Chairman of this Board to
execute same on behalf o~ the County of Butteo

COOPERATIVE AGREEMENT FOR
DEER iiABITAT I1+~PROVEMENT
;
THIS AGREEP4ENT In accordance with the provisions of the A~t
• of June 30, 1914 (16 USC 498}, made and entered into this
13th day of March , 1973, by and betwean the Butte
Caunty Boa~d of Supervisors, hereinafter ~eferred to as the
"County", and the Forest Supervisor, Plumas Na~.ional Forest,
hereina~ter referred to as the "Forest Service",
WTTNESSETH:
WHEREAS, Sec~ion 13100 of the Cal.ifornia Fish and Game Code
provides that one-half of the fines and forfeitures collected
for fish and game law violations shall be deposited in a
County fish and game fund, and,
WHEREAS this fund shall be expended for the propagation and
conservation of fish and game, and,
WHEREAS competition for forage by deer on the Bucks ~Sountain
and Moore~.own Deer Iierd winter ranges becomes critical during
severe winters, and,
WHEREAS it is mutually advantageous to the Forest Service
and to the Caunty to improve forage conditions for deer and
other wildlife wherever and whenever practical, and,
WHEREAS the Sawmill Peak and Bal.d Rock Areas Habitat Improve-
ment project proposed by the Forest Sezvice will provide for
improved forage and habitat conditions for deer and other

wildlife on National Forest lands'within the critical deer
winter range,

NOW, TEiEREFORE, it is mutually agreed as follows:
1. mhe County will as requested by the Forest Service,
pay $3,d00.00 in advance to be deposited in the Forest
Service Cooperative work Fund, such sum to be expended
by the Forest Service for paying the cos~ of said habitat
impzovement, a.ncluding indirect expenses. If the County
desires to expend money for additional habi~.a~ improvement
work not covered by the initial deposit above, such sums
must be deposited in advance o~ work when calle3 for by
the Fores~t 8ervice.
2. The ~'orest Servzce will perform the necessary work to
improve said haba.tat to ~he extent such work may be
necessary or to the extent that funds therefor, contrz-
buted by the County may be available.
3. That any unobligated balance in the sum so deposited
by the County under the provision hereof, shall upon
termination nf this agreement be refunded to the County
by the Forest Service: .
4. Should any ~uch deposit be reoeived by the Forest
Service after the date of the start of this agreement,
it is understood and agreed that all or any portion~thereof,
as may be needed, will be credited as an appropriation

ini~ially obliga~ed, or to the appropriations currently
available at the time o~ the deposit to cover the aost
of ~mprovzng said habitat.
5. No member.af ar Delegate to Congr.ess or R~sident
. Commissioner shall be admitted to any share or part of
this contract or to any bene~it to arise therefrom.
Nothing, however, herein containe8 shall be construed
~o extend to any incorporated company, ~f the contract
is for the general benefi~ of such corporation or company.
6. Th~s agreement will be in force from the date first
shown above until June 30, 1975, both dates i~clusive,
or unti~ the coopera~ive work on said lands is completed,
unless otherwise terminated by m~tual agreement or an
30 days' wri~ten notice from either party to the other.
IN WITNESS WHEREOF, ~he parties hereto have~caused this
agreement to be executed as of the date hereinabove written.
