IT IS HEREBX RESOT,VED by the Board of Supervisors of the County of
Butte, State of Califoraia, that Chairman of the Boaxd is hereby authorized
and directed to execute Right o£ Way Cer~ification No. 2 dated A~i~ ~4 ,
1973, for the Manzanita Avenue Brfdge across Big Chico Creek, TOPICS ProjecC
No. EPS-T-301~(3) in the name of the CounCy of Butte.
Be it furthex resolved that the CounCy of Butte agrees to hold the
State of California l~armless from any liabi7.ity which may result in the event
the right of way is not cieax as certified. If the State i.s named in a damage
suit, as a resulC of the right oS way not being clear as certified, the County
of Sutte agrees thaC, at the request of the State, i~ wiZl assume fu7.Z respon-
si.bility for the conduct of the de~ense or provide such assistance as the StaCe
may require and wi11 pay any judgznents issued againsti the State and a11 costs in
connection with the defense.

request of the State, it will assume full responsibility for the conduct of the
