State of California, that Chairman of the Board is hereby authorized and directed
to execuCe Right-of-Way Cex'ti.fication No. 3 dated Ms.~ 8F„ ~
1973, in the name of the County of Bu~tie.
Be iC further reso3.ved that the County of Butte agrees-to hold the State
of California harmless from any liability which may resu7.t i,n the event tE~e right
of way is not clear as certified. If the 3tate is named i.n a damage suit, as a
resu3~t of the right of way not being clear as certified, the County of BuC~e agre s
that, at the request of the Staee, it will assume ~u17, responsibility for the con
duct of the de£ense or provide such assistance as the State may require and will
Ipay any judgments i.ssaed against the SCate and a11 costs in connection with the

Th~ County of Butte agrees to hold the State of California harmless from '
any IiabiZity which may result in the event tfie right of way is not clear as '
certified. If t~e State is named in a damage suit, as a result of the right
of way not being clear as cer~ified, the Gounty o~ Butte agrees that, a~ the
request of t~e State, it wiZl assume £ul~ responsibxlzty £or the conduct of the
defense or provide such assisfance as tha State may xequire and will pay any
judgments a.ssued aga~nst the State and all costs in connection with the defense.
