IT IS H~R~BX RESOLVED by the Board of Supervisors of the Gounty of
Butte, State of California~ that Chairman of the Board is hereby authorized
and directed to execute RighC of 'Way Certification I3.o. 2 dated _„ June 12.
, 3.973, £or the East Avenue TOPICS Project No. EPS-~-3014(4)
in the name of the County of Butte.
Be it further resolved that the County of Sutte agrees to hold ~he
State o€ California harmless from any liability which may result in the event
the right of way is no~ cl.ear as certified. If the S~a~e is named in a damage
suit, as a resul~ ofi the zight of way not being clear as certified, the County
of Butte agrees that, at the request of the Seate~ it will assume ful.1 respon-
sibility ~or the conduct of the defense or provide such assistance as the
S~ate may requz.xe and wiZl pay any judgments issued agarnst the State and all
costs in connection wi~h ~he defense.
