HomeMy WebLinkAbout73-099Resolnfion No.73-99 ~~ RESOLUTION ADDING SECTION 2P TO TEIE RULES OF THE BUTTE COUNTY ASSE$SMENT APPEALS BOARD BE IT RESOLVED pursuant to Butte County Code Section 21-5~s that 5ection 28 of the Rules for the Assessment Appeals Board of the Co~nty o;` Butte is hereby added to read: Section 28. EXCHANGE OF INFORMATTON, (a) REQUEST BY A1'PLIGANT. At the time of fil9.ng the application or at any time prior Co 20 days before the heaxing on the application, the applicant may file with the clerk a written request for information from the Assessor, and tihe clerk shall immediately forward the request or a copy thereof to the assessor. The request sha11 contai.n the basis of the applicant's opinion of value and the follawi~ng data: (1) COMPARABLE SALES DATA. If the application is to be supported with evidence of co:uparable sales, the properties sold shall be described by khe assessor's parcel ntsmber, street addzess or legal description sufficient to identify them. With regard to each property sold there sha7.1 be presented: the approximate date of sale, the price paid, the terms of sale (if known), and the zoning of the properCy, (2) INCOME DATA. If Che application is Co be supported with evidence based on an income study, there shall be presented; the gross income,, the expenses, and the capitalization meChod and rate or rates employed. (3) C05T DATA. If the application is to be supported with evidence of repJ.acement cost, there shall be presented: (A) With regard to improvements to real property: the date of construction, type of construction, and replacement cost of constructian. (B) With regard ~o machinery and eruipment; the date of. installation, replacement cost, and any history of extraordinary use. {C) With regard to both improvements and machinery and equipmenti: f.acts re~ating to depreciation, inclading any funetiional or economic obselescence,.and remaining economic life. (b) ASSESSOR'S DATA TO A~PLICANT. Zf an applicant for a change of an assessment has submitCed the data re~uired by subdivision (a) with~n the time speciiied, the assessor, ae least 10 days prior to the hearing, sha11 mail to the applicant, at the address shown on the application, a wrieiag which shall set ~arth the basis of the assessor's opinion of. value and sha11 contain the same tyge of data as provided in subdivision (a) in support of that opinzon. (c) PROHIBITED EVrbENCE; NEW MATERTAL; CONTINUANC~, Whenever information has been exchanged pursuant to t~is section, Che parties may introdace evidence only on matters so excfianged unless the other party consents to introducCion o~ other evidence. However, at the heazing, each party m2y introduce new material relating to the information recezved f.rom the oCher party. If a party introduces new m2tierial at the hearing, the other party, upon re4uest, shall be granted a continuance £or a reasonable period of"time.
