RE50LUTION OF PRELIMINARY DE~EF2MINATION TO UNDERTAKE
SPECIAL ASSESSMENT PROCEEDINGS FOR THE CONSTRUCTION
OF IMPROVEtdENTS AND ACQt7ISITrONS TO BE MADE IN
FIRLAND ACRES ASSESSMENT DISTRICT, COUNTY OE BUTTE,
STATE OF CALIF'ORIVIA
BE IT RESOLVED by the Board of Supervisors o£ the County
of Butte, State of California, as follows:
1. Peti~ion for the construction of improvements and
acquisitions by special assessment praceedzngs withi~ the boundaries
of the map designated, "Propased BoundarS.es of Firland Acres Assess-
ment Districti, County of Butte, State of Cal~fornia," which said
map is on file in the office of the County Clerk o£ the County of
Butte, is incorporated herein by this referencE as though fully
set forth herein.
2. The Certificate of Walter B. Grimes dated the 26th
day of Juns, Z973, certifya,ng that the petition hereinabove referred
to was signed by the owners of more than sixty per cent (60~) of
tlie area of the property described a.n said pe~ition, is incorporated
herein by this reference as though fully set forth herein.
3. It is hereby nrdered and determined that the terms
and conditions of said petition heretofore incorporated herein be,
and they ~re hereby accepted; that the improvem~nts and acquisitions
shall be made in accordance with the terms of said petition; that
~ the assessment di.stric~ proceedings shall be inatituted and carried
through in accordance with the terms af said pe~ition.
4, iti is hereby found, detezmined and ordered that the
Director of Public Works of the County of Sutte shal~. be Engineer
of Work and tha~ Walter.B. Grimes Assoc, shall be Project ~ngineer
in accordance with the tierms and conditions of the contract to be
entered into. It is further ordered that STURGIS, pEN-AIILK, DOUGLASS
&~1NDERSON, At~orneys at Law, Oakland, Cali.fornia, shall be Special
Bond Counsel to prepare aZl proceedings in accardance wa.th the terms

and conditions of the contract`td be entered znto.
5. That the public interest and convenience will be served
by the taking of special assessment proaeedings for the improvements
and acquisitions set forth in said petition. The cost and expen-
ses thereo~ should be borne by a distrzct benefited by said improve-
ments and acquisitions. Said district shaZl be known and desig-
nated as Fir~and Acres Assessment District, County of Butte, 3~ate
of California.
6. The district whiah shall bear the cost and expenses
oF 5aid improvemenfis and acquisitions, including alI incidental expen-
ses, and which is to be assessed to pay for the cost of said improve-
ments and acquisitions is that district shown on a map which zs on
fiie in the office of the County Clerk of the County of Butte, which
is designated, "Proposed Boundaries of Firland Acres Assessment
llistrict, County of Butte, State of California."
7. Said special assessment proceedings are to be taken
under the provisions of the Municipal Improvement Act oP 1913 with
bonds to be issued under the grovisions of the Improvement Act of
1911.
8. No contract for the construction ot improvements in
this assessment district shall be awarded un~il improvement bands
are sold and delivered and the proceeds of such saie are depasited
with the County Treasurer.

I HEREBY CERTIFY that the foreqoing Resolution was duly
and regularlp adopted by the Board of Supervisors of the County
of $utte, State of Ca~ifornia, at a regular meeting thereof, held
on the 26th day of June, 1973, by the fol~owing vote, to wit:
