BE iT RESOLVED by the Board of Sunervisors of the County of Butte, State of Ca3.ifornia, that WALTER B. GRIMES ASSOC. be arid it is hereby appointed as Project Engineer for the doing o£ al]. necessary engineering work and exercising a].1 af the engineer- ing functions pravided for under the pravisions of the Municipal Improvement Act of 19].3 in connection with the imprnvements and acquisitions to be made in progosed Firland Acres Assessment Dis- trict, County of Butte, State of Calitornia; and BE IT FURTHER RESOLVED that the employment of the said WALTER B. GRIMES ASSOC. shall be as provided in the attached agreement; and SE IT FURTHER RESOLVEB that the Chairman of the Board of 5upervisors of the County of Butte be authorized to sign, and the County Clerk thereof be authorized to attest, that certain agree-- ment employing the said WALTER B. NELSd21, County Clerk, County of Butte, State ot Cal.ifornia ~/.~-~- ~ ~~Z~ A G R E E M E N T THIS AGREEI~NT, made and entered into this 26th day of June, 1973, by and between the Gounty of Butte, a political sub- division of the State of California, hereinafter called First Party, and WALTER G. GRIM~S ASSOC., hereinafter called Second Party; W I T N E S S E T H: That for and in consideratzon of the mutual covenants and agreements herein contained, the parties hereto agree as follows: l. First Party proposes to initiate special assessment proceedings for the impzpvements and acquisitions in Firland Acres Assessment District, Coun~y of Butte, State ot California. 2. First Party employs Second Party as Psoject ~ngineer for the doing of all neaessary work and exercising a11 engineering functions provided far by the provisions of the MunicipaZ Improve- ment Act of 1913 in connection with t~e said improvements and acqui- sitions to be made in said district. Said services shall inclu8e the following: a. Daing of all necessary engineering work and exercising of all engineering functions pro- vi.ded ~'or under the provisions of the Muni- cipal Improvement Act of 3.913; b. Preparation and furnishing of all surveys, original drawings, maps and b3.ueprints, pZans and specif~catzons, preparation of assessment roll, assessment diaqram, and any and a11 other services which may be required under the provisions of tha said riunicipaZ Improve- ment Act of 1913; i c. Supervision and direction of all engineering work required to be taken by First Party or its of£icers, agents or employees, in con- nection with said improvements. Said duties shall include furnishing, on or before the date fixed for filing of the Engineer's Report, a J.ist of the names and addresses pf a13. pzoperty owners within the bound- aries of the dis~rict as shown on the last equa~ized roll for taxes or as known to the Engi.neer. Sai.d list shall include coordina~ion ot th~: naine and address with the assessment and diagram number, and the proper description of the property or the Countl 1~ssessor's parcel number oP each 1ot, piece, or parcel ot land shown an the assess- ment diagzam, when appropriate. -1_ ~~~~~~~~~~~: ~~~~ E ~ d. Rendition o£ general consul~ation and advice to First Party, its otficers, agents, or empZoyees with respect to the planning, pre- paration and handling of all engineering phases af the aforesaid proceedings; e. Attendance ati such conferences and public meetings with First Party as may be reasonably necessary to perform this contxact of employment. 3. Second Party shali receive compensation for the above services as fo~lows: The sum of Three Thousand Fifty Dollars ($3,050.00). The above amount shall be paid by First Party out o£ the proceeds nf assessments levied and bonds to be issued in said proceedings 4. In the event sazd proceedings are not carried through to conclusion, or shall be abandoned, then Second Party shaZl receive notihing. ` IN WITNESS WHFREOF, the partias have hereunto subscribed their names, First Party by its Chairman of the Board of Supervisors, attested by its Caunty Clerk the day and year in this agreement first above written.
