BE IT RESOLVED by the Board of Supervisors of the Caunty
of Butte, State of Califoxnia, that said Board finds and determines
and hereby declares, as £ollows, to wit:
l. That public interest and necessity require the
acquisition, construction and completzon by the County o~ Butte,
of a public improvemeat, namely, a county highway known as Skyway
in the County of Butte, State of Cali~ornia,
2, Ti~at public interest and necessity require the
acquisition for said improvement of the real property, or interest
in the real property hereinafter described, ~ogether with all
improvements situate thereon, and it hereby fovnd and determined
that the construction of a county highway is a public use, authorized
by law, and that public interest and necessity rec~uire the construction
ofr said i.mpravements and the acquisition of said real property herein.-
after descra.bed, and all improvements situate thereon.
3. Said proposed public improvement is planned and
located in a mann.er which will be most compa~Cible with the greatest
public good and the least public injury.
4, That the County Counsel o~ the County of Butte is
hereby au~horized and empowered as fo1].ows:
(a) To acquire, in the name of the County of Butte,
a fee simp].e estate or such nacessarq interests in and to the
hereinafter described real proper~y, ox interest in real property,
and all improvements thereon by condemnation in accordance wi.th
the px~ovisions of the Streets and Highways Code, Code of Civil
Procedu~e and the Constitution of the State of California, relating
to ema~nent domain, to authorize the auditor to pay from county funds

authorized to make such payment on authorization,
(b) To prepare and prosecute for the County of
Butte, such proceedings in the proper court havimg j'.urisdiction
thereo~, and make such deposits from County funds for fees and costs
as are necessary for such acquisitiono
{c) To make application to said cour~ for an order
fixing the amount of security in the way of monies deposited as
said court may direct, and for an order permitting the County of Butte
to take immediate possession a nd use of said real property, or
interest, or improvements in said real property, as a right-of-way
for a public highway for publie usea
(d) To make deposit of such security out of proper
funds under tne control of the County of Bu~te, in such amounts
as fixed and determined and in such man.nex as said Court in which
condemnatzon proceedixigs are pending may direct, and the Auditor s
authorized to make said deposit ~mmediately upon the ~ourt making
said orders.
5, Tb.at rea~ proper.ty, or interest in real property,
and/or improvements thereon, which the County of Bu~~e is, by this
resolution, authorized to acquire for said public improvements in
fee simple is situate in the County of Butte, State of Calz~ornia,
more particularly described in Exhibit "A - Parcel 1" through
Exhibit "A - Parcel 4" attached hereto and made a part hereof by
reference as if set forth in ~uii.

Gounty of Butte, State of California, this 14th day of August, 1973,
