RESOLUTION AUTHORIZING THE C~TATRMAN OF THE
BOARD OF SUPERVISORS TO FXECUT~ AGREEMENF
ON BEHALF OF THE COUNTY OF BTJ'T'I'E
BE IT RESOLVED, tha'~ 'the Board o€ Supervisors of the
County of Butte hereby approves the attached agreement between
the 5tate of California and the County of Butte and hereby
authorizes the Chairman o£ this Baard to execute same on beha~.f
of the County of Butte,

TtiIS AGREEMENT, made and entered into on this
• day of , 19_, by and between the STATE OF CALIFORNIA,
acting by arid through the Department of ~'zansportation (herein re-
~e~red to as "STATE"), and t~e CpuntX of But~e (herein referred ~o
as "COUNTY") ,
~ WITNESSETH:
WHEREAS, the highway described above has been declared.to
be a freeway by Resolution of the Califarnia ~Iighwap Commission on
April 3.8, 3.951; and
WHEREAS, STATE and COITNTY have entered into a Freeway
Agreemen~ dated April 30, 195~, re].a~i.n~ to tiiat portion of State
Highway Route 99 between Oroville LVye and Centervi.lle Road; and
WHEREAS, a revised plan map for such freeway has been
prepared showing the proposed plan of the STATE as it affects roads
Of the COI7i~ITY; anc~
WH~REAS, it is the mu~ual desire of fihe parties hereto
to enter into a new Freeway Agreement i.n accordance with tt-e revised
plan of said freeway;
i~TOW, TFIEREFORE, IT IS AGREED:
1. This Agreement supersedes that portion o~ said Free-
way Agreement dated April 30, 1951 ~r•om the junction of Route 99/149
to 0.4 mi.le south. of the East Fork ot Robez~-~s Creek (FIamlin Sl.ough) .

2. COUNTY agrees and consents ~o the closing of COUNTY
roads, relocation of COLNTY roads, construc~ion of frontage roads
' and other local roads, and other construction affecting CO[7NTY' roads,
all as shown on said plan map a~tached hereto marked Exhibit A and
made a part hereof by this reference.
3. STATE shall, in construction of the freeway and at
STATE'S expense, make such changes affecting COiT~TTY zoads in accor-
dance with the p3.an map attached hereto marked ~xhibi.t A. STATE
may, at STATE'S expense. install signs, signals, and other traffic-
con~rol devices at appropriate locations to be d~termined by STATE
in order to regulate, warn, or guicle traffiic upon ~he highways.
4. STATE agrees ~a acquire a11 necessazy right of way as
may be required for construction, reconstruction, or alteration of
COLNTY roads, fron~age roads, and other local roads, and COUNTY
hereby aufihorizes STATE to acquire in its behalf all such necessary
~xgh~ of way.
5. It is understood between the ~arties that the right
of raay may be acquired in sections or units, and that both as to
the acquisition of sight of way and the construction of the free~aay
projects, the obligations ot STATE hereunde~ sna11 be carried out
at such time and tor such unit or units of the project as funds are
budgeted and made lawfully avai.lable for such expenditux~es.
- 6. COUNTY wi11 accept control and maintenance over each
of the relocated or reconstructed COUNTY roads, and the frontage
roads, a.nd other STATE constructed local roads an seceipt of writ-~en
notice to CdUN~Y from STATE that ~he work fhereon has been completed,
except for any par'tion wh'ich is adopted by STATE as a.part ot the

freeway proper. COUNTY will also accept title ~o the portions of
such roads lying outside the freeway limi~s upon relinquishment by
STATE.
7. Tha.s Agreement may be modified at any time by the
mutual consen~ of the garties hereto, as may become necessary tor
the best accomplishmen~, through STATE and COtTi~TmY cqoperation, of
~Ehe whole freeway project for the benefi~ of fhe peop~e of the STATE
and of the COiJNTY.
IN WITNESS WHEREOF, ~he parties hereto have caused this
Agreement to be executed by their respective duly autlzorized ofticers.
