RESOLUTTON AUTHORIZING ACQUISITION OF R~AL PROPERTY BY EMi~IENT DOMt1IN
1 NECESSARY FOR THE CONSTRUCTTON OF A. COUNTY HTGHWAY I~IOWI3 AS I~LEGAN LANE

3 BE IT RESOLVID by the BOARD OF SUPBRVTSORS of the County of Butte, State
4 of California, that said Board ~znds and detexinines and hereby declares, as
5 follows, eo wit:
g 1. That public interest and necessity require the acquisition, con-
7 struction and completion by the County of Butte, of a public improvement,
g nameJ.y a County Highway Irnown as Hegan Zane, i.n the County of Butte, SCaCe of
g Ca7.zfornia,
~p 2. That public interest and necessi.ty require the acquisition for said
i1 improvement of the real property, or interest i.n the real property hereinafter
12 descri.bed, together with all improvements s9.tuate thereon, and it is hereby
~g found and determined that the construction of a Count}r Highway is a public use,
14 authorized by law, and that pubZic i.nterest and necessity require the construct~
~5 ion of said improvements and the acquisition of said real property hereinafter
16 described, and a11 improvements situate thereon.
Yq 3. Said proposed public improvement is planned and located in a manner
Zg which wi11 be mos~ compatible with the greatest public good and the least
~g pri.vate injury.
20 ~• Z`hat the Couney Counsel of ehe County of Butte is hereby authorized
2Z and empowered as fo3.lows:
22 (a) To acquire, in the name of ehe Coun~y of Butte, a fee si~ple estate
23 or such necessaxy znterests in and to the hereinafter described real property,
24 or interest in real propexty, and a11 improvements thereon by condemnaCion i~
2g accordance with the provisions of the Streets and Hzghways Code, Code of Civil
2B Procedure and tihe Constitution of the State of Cali.~orzxia, relating to eminent
domain, to authorize the audiCOr tio pay from County funds the costs and

consideration for said acquisition, and the suditor is authorized to make
such payment on authorization.
(h) To prepare and prosecute for the County of Butte such proceedings
in the proper court having jurisdiction thereof, and make such deposits from
County funds for fees and costs as are neeessary for such acquisitian.
(c) To malce application eo said court for an order fixing tha amount
of security in ehe vray of moneys depositied as said cour~ may direce, and for
an order permitting the County of Butte to take immediate possession and use
of said real property, or i.nterests, or i~mproveznents i.n saa.d real property,
as a right of way for a public highway for public use.
(d) To make deposit of such security out of proper funds under the
control of the County of Butte, in such amounts as fixed and determined and
in such manner as said coixrt in wlach condemnation proceedings are pending
may direct, and the Auditor is authorized to make said deposit imanediately
upon the court makfng said order.
5. The real property, or interest in. real property, and/or improvements
thereon, which the Gounty of Butte is, by this Resolution, authorized to ac-
quire for said public i.mprovements in fee simple, is situate in the County
of BuC.~e, State of California, more particularly described in Exha.bit "A",
attached hereto and made a part hereo£ by re£erence.
