AN ORDINANCE PROVIDING FOR THE PREPARATION
AND CARRYING OUT OF GN IL DISASTER PLAN FOR
BUTTE COUNTY: PROVIDING FOR GOORDINATION OF
CIVIL D.ISASTEIt FTNGTIONS OF THE COITNTX OF BUTTE,
THE CITIES OF CHICO, OROVILLE, GRIDLEY AND BIGGS,
AND OTHER PUBLIC AGENCIES WITHIN SAID COUNTY:
PROVIDING A PENALTY FOR VIOLATION THEREOF:
REPEALING BUTTE COUNTY ORDINANCE N0. 41,.7, PASSED
AND ADOPTED FEBRUARY 13, 1951.
The Board of Supervisors of the County of Butte do ordain as follows:
SECTION 1. Purpose-. The declared purposes of this ordinance are to
provide for the preparation and carrying out of plans for the protectian
of person and property within the County of Butte in the event of a disaster,
and to provide for the coordination of the civil disaster functions of the
Qounty of Butte with the cities of Chico, Orovil.le, Gridley and Biggs and
all other affected public agencies, corporations and organizations within the
County of Butte.
SECTION 2. Definitions.
A. Civil Dafense. As used in this ordinance, the term 'Civil
Defense° shall mean the preparation for the carrying cut of all emergency
functions, other than functions far which military forces are primarily
responsible, to prevent, minimize, and repair injury and damage resulting
from disasters.
B. Disaster. As used in this ordinance, the term "disaster's
shall mean actual or threatened enemy attack, sabotage, extraordinary fire,
flood, storm, epidemic, riot, earthquake or other similar public calamity.
SECTION 3. Civil Disaster Council, The Butte County Civil Disaster
Council is hereby created and shall consist of the following:
A. Two members of the Board of Supervisors of the County, one of
whom shall be the Supervisor of tha fifth Supervisorial district.
B. The Mayor of each pity in tha County or councilman selected by
the Mayor of each city.
C. The 6uperintendent of Schools of the County.
D. The County Administrative Officer, who shall serve as an ex-officio
member of the Civil Disaster Council without vote,
E. The City pdanager or other administrative employee, as determined by

1 each city council, who shall serve as an ex-officio member of the
,2 Civil Disaster Council without vote.
,3 SECTION L,., Civil Disaster Caun_cil. Powers and Duties. it shall be
g the duty of the Butte County Cavil Disaster Council, and it is hereby.
5' empowered, to review and recommend for adoption by the Board of Supervisors
g and city councils, civil defense and disaster-and mutual aid plans and
'7 agreements, and such ordinances and resolutions, `and rules and regulations,
g as are necessary to implement such plans and agreements. The members of
'I g' the Civil Disaster Council shall elect a chairman, vice-chairman, and such
10 other officers as they deem necessary and they shall prescribe their own rules
Vii' of procedure. The Civil Disaster Council skall:~neet upon call of the chair-
12 man, or, in his absence from the county, or inability to ca71 such meeting,
].3 upon the call of the vice-chairman.
7.4 SECTION 5. Director of Butte County Civil Disaster.
15'' Powers and duties.
16 There is hereby created the position of Butte County Director of
t 7 Civil Disaster. The Director shall be selected by the Civii Disaster Gounsal,
''18 be confirmed by the Board of Supervisors, and be responsible to the County
19 Administrative Officer for the day to-day management of the civil disaster
20 program. The Director is hereby empowexed:
21 A. To request the Board of Supervisors, through the County
22 Administrative Officer, to proclaim the e~.stence, or
X23 threatened existence of a disaster and the termination
24 thereof. If the Board of Supervisors is not in session
25 the Director may request the County Administrative Officer
~~' to issue such proclamation subject to confirmation by-the
27 Board of Supervisors at the earliest. practicable time.
28 B. With the approval of the Civil Disaster Council, to request
29 the Governor to proclaim a state of extreme emergency when
30 in the opinion of the council the resources of the area or region
3 1 are nnadequate to cope with the disaster;

, To control and direct civil disaster activities and efforts for
2 the accomplishment of the purposes of this ordinance;
$ D. To d~sect coordination and cooperation between divisions, service
4 and staff of the civil disaster organization, and to resolve
6 questions of authority and responsiba.lity that may arise between
6 them;
ry E. To repxesent the civil disastex organization in all dealings
with public or private agencies pertaining to civil defense and
J disaster;
10 F. Tn appoint service chiefs subject to the approval of the Civil
"1'j, Disaster Council; PROVIDED, HOWE[TER, the service chiefs so
12 appointed shall in so far .as possible, be employees who hold
13 regular administrative positions Frith the County and the cities.
14 G. Prescribe in writing the duties of any assistants provided him
15 and the duties of chiefs of services, in conformity with the
(16 Butte County oivil disaster plan. Such duties may be changed
~q from time to time by the Director, particularly for the purpose
lg of conforming to recommendations of the Director of the California
19 Disaster Office or the Federal Office of Civil Defense;
,'20 H. The Director shall develop a civil disaster plan and program from
'21 Butte County and shall have such other duties as may be assigned.
;22 SECTION 6. Disaster and emergency op we_r_s of the director.
23 In the event of the proclamation of a disaster as herein provided, or
24 the proclamation of a state of disaster by the Governor or the Director of the
{gg California Disaster Office, the director is hereby empawered:
', 26 A. To make and issue rules and regulations on matters reasonably

~, related to the protection of life and°~property as affected by
28 such disaster; provided, however, such rules and xegulations must
29 be confirmed at the earliest practicable time by the Civil Disaste
30 Council.
31 B. Subject to the agpxoval of the Board of Supervisors or County,'_
32 I Administrative Officer to obtain vital supplies, equipment and such other

properties found lacking and needed for the protection
of. life and property of the people, and bind the County for
the fair value thereof, and if required immediately to commandeer
the same for public use.
C. Subject to the general direction and approval of the County
strative Officer:
1. To requixe emergency services of any county officer or
employee and to command the-aid of as many citizens of
the County of Butte as he thinks necessary in the execution
of his duties; such persons shall be entitled to all
privileges, benefits and immunities as are provided by
state law for registered civil-disaster worker volunteers.
2, To requisition necessary pe~spnnel or material of any County
department or agency;
3. To exercise complete authority over the County and to exer-
cise all police power vested in the County by the Constitution
and general laws.
SECTION 7. Civil disaster organization. All officers and employees of
the County of Butte, together with those volunteer forces enrolled to aid
them during a disaster, and all groups, organizationa and persons including
persons commandeered under the provisions of Section 6 of this ordinance, who
may by agreement or operation of law be charged with duties incident to the
protection of life and property during such disaster, shall accept and
discharge such duties and responsibilities in the Butte County civil disaster
organization as they may be assigned.
SECTION 8. Divisions. services and staff of the Butte County civil
disaster organization.
The functions and duties of the Butte County civil disaster organi-
zation shall be distributed among such divisions., services and special staff
as the Butte County Ci~i1 Disaster Council sha71 prescribe by resolution
subject to the approval of the Board of Supervisors and the city councils.
SECTION 9o Punishment of violation, It shall be a misdemeanor, punish-

or by imprisonment for not to exceed six (6) months, or both, for any person
during a disaster:
Ao Wilfully to obstruct, hinder or delay any member of the Butte
County civil disaster organization in the enforcement of any
lawful rule or regulation issued pursuant to this ordinance, or
in the performance of any duty imposed upon him by virtue of this
ordinance;
B. To do any act forbidden by any lawful rules ox regulations
issued pursuant to this ordinance, if such act is of such a
nature as to give, or be likely to give, assistance to the enemy,
or to imperil the lives or property of inhabitants of the County
of Butte, or to prevent, hinder, or delay the defense or protec-
Lion thereof.
SECTION 10. Expense. The expense of the civil disaster program not
otherwise paid for by federal and state agencies sha11 be shared by the County
and the cities in the following proportions: County, 75~; City of Chico, 159;
City of Oroville, 6%; City of Gridley, 3~S and City of Biggs, l~.
SECTION 11. Rs eel of conflictin ordinances. Ordinance No. L,L,.7, passed
and adopted February 13, 1951; and said ordinance is also codified as Section
107 of Ordinance L,.67 (the County Code), both of which are hereby repealed.
This ordinance sha11. take effect thirty (30) days after the date of its
adoption, and before the expiration of fifteen (l5) days after its passage, it
shall be published with the names of the members voting fox and against the
same, once, in a newspaper published in the County of Butte, State of Cal3forni .
PASSED AND ADOPTID by the Board of Supervisors of the County of Butte,
State of California, at the regular meeting thereof on the nth day of
March , 1962, by the following vote:
AYES: Supervisors Giles, Pittman, Steinegger and Chairman Alldredge
