OF THE COUNTY OF BUTTE
(Section 21023.6, Governmen~ Code)
WHEREAS, the County of Butte (hereinaf~er ~eferred
to as Agency) is a contxacting agency of the Public
Employees' Retirement 5ystem;
WflEREAS, the Public ~mp7.oyees' Retirement Law
requires that a contracting agency de~ermine wk.~ether an
employee of such agency in employmen,t in wha.ch he ~.s
classi£ied as a 1oca1 safety member is disabled for purposes
of the Public Employees' Retirement Law and, whether such
disability is tBindustrialiQ within the meansng of such law;
WHEREAS, the Board of S`upervisors of the Coiu-ty of
Bv.tte has detertnined upon legal advice that it may delegate
autk~or~.ty to make such determinations to the incumbent of
t~.e position, of Personnel Director;
NOW, TNEREFORE, BE IT RESOLVED:
That the Board of Supervisors of the County of Butte
delegate ar~d it does hereby delega~te to the incumbent of the
positian of Perso~,el.Director authority to make determinat9.ons
under Section 2I023.6, Government Code, on behalf of the
Agency, of disability and whe~her such disability is industx~ial
and to certify such determinations and a11 other necessaxy
inforntation to th.e Public F~tnployees' Retirement ~stem; and,
BE ZT FURTI~'ER RESOLVED that such incumbent be an~.d
he is authorized to make applications on behalf of the .Agen~y'
for disability reti.rement of emp~oyees in employments in
which they' are local safety members and to initiate requests
for reinstatement of such amployees who are retired for disability.
