and hereby decl.a~es~ as folZows, to wit:
Io That public interest and necessity require the acquisition,
constrnction and completion by the County af Butte, of a public
improvement, namel.y, a county highway known as 5kyway in the County
of Butte, State of California,
2, That public interest and necessi~ty require the acquisition
for said improvement of the real property, or interest inthe real
property hereir~after described, together with a3.1 improvements
situate thereon, and it hereby found and defi,erm~.ned that ~t he con-
struction of a county highway is a public use, au~ho~ized by 1aw, and
that public interest and necessity requzre the construction of said
improvements and the acquisition of said real property hereinafter
descri.bed, and all improvements situate thereon,
3, Said proposed public improvement is p~.anned at~d located
in a manner ~rhich w~.I.7_ be most compatible with the greatest public
good and the least public injury.
4. Tkzat the Coun~y' Counse7. af the County of Butte is hereby
authorized and empow'ered as follows:
(a) To acquire, in the name of the County of But~e, a
fee simple estate or such necessa~y interests in and ~Co the herein-
after described real property, ar interest in real property, and all
improveanents thereon by condemnation in accordance wi~h t$e provisions
of the Streets and Highways Code9 Code of Civil Procedure and the

Constitution af the State of California, relating to eminent domain~
to authorize the auditor to gay from county funds the cos~s and
consideration for such acquisition9 and the auditor is authorized
to make such payment on authorization,
(b) To prepare and prosecute for the County of Buttea
such proceedings in the proper caurt having jurisdiction thereof'
and make such deposits fram County funds for fees and costs as are
neeessary for such acquisition,
(c) To make application to said court for an order
fixing the amount of security in the way of moneys deposited as said
court may directy and for an order permitting the Caunty of Butte to
take immediate possession and use af said real propertyy or 3nterest,
or improvements in said real property9 as a right-of-way for a public
highway for public nse,
(d) To make deposit of such security out of proper ~unds
under the control ot the County of Butte9 in such amounts as fixed
and determined and in such manner as said court in which condemnation
proceedings are pending may direct, and fihe Auditor is authorized to
make said deposit immediately upon the court making an ordero

improvements fihereon, which the County of Butte isy by this resolution,
authorized to acquire for said public improvements in fee simple, is
situate in ~tt~e County of Butte9 S~ate of Calitornia, more pa~ticularly
described in Exhibit '~A~x attached hereto and made a part hereof by
reference as if sat forth in full.o
