RESOLUTION AUTHOItIZTNG AGREE~SSENT BETWEEN COUNTY OF BUTT~
AND S~UTHERN PACIEIG COMPANY

NORD HzGHWAY CROSSING C-190.8, NORD
BE IT RESOLVED by the Board of Supervisors of the County of Butte,
State of California, as follows:
1. That said Board hereby approves that certain indenture made the
19fh day of February , 1974, by and between SOUTHERN PAGIFIC C0~IPANX
and COUNTX OF BUTTE, covering ~he installation of automatic signal protecti.on
at Southern Pacific Crossing C-].90.8.
2. The Chairman of this Baard is hereby authorized fio execute, on
behalf of the Coun~y of Butte, said indenture, and his signature attested to by
the Clerk of this Board, and acknowledged.
3. That a certi€ied copy of this Resolution be attached by the C1erk
of said Board to said indenture and the required copies thereot.

2o Caun~y agrees to reimburse Railroad for ~i~ty percen~
~5p%) of a11 cost ar.d e~:pense incurred by Pailxaad in connection
with tl~e furnzshin~ and installation of said signals, remova~ ot
existing crossino signs and the alteration, raising andfor xeloca-
tior, o~ Railroadp s overhead co:nznunication and signal ~aires, poles,
guy wires and appurtenances. ~'he estimated cost co County is
$15,950.
3o Notwithstanding the agportionment of constructzon and
mainl:enance costs ~:o be incu?'red by Railroad as hereinabove set
forth, shauld CounCy be allotted Federal funds fpr a11~or a por-
ti.on thereof Railroad sha11 b~ reimbursed in accordance with
applica~le laws and regulations; and Railroadts ~ight to reim-
bursement sha1~. not be limited by any other provis~.on of thi.s
agreement. •. .

promptly pay.
Upon completi~on o~ fina~ audit, should Coun~y's share of
the actual cost and expense prove te be more oi Less than the

resultant method of appoxtioning the cost af constructing crossing ,
pratecicive sig~als, the cost o~ r~aintaining sa~.d signal.s sha11 be b
bo~-ne and pa,id fifty percent t50%) by Railroad and fifty pexcent {50~0)
b~= County; and Cour.ty`s liability for such maintenance cost shall be
litni~ed to such funcls as are set aside ~or allocation by the Californi~
Public Utilities Commission pursuant to Section 123101 of the Ca1:~fa~-ni
~'ubl.ic U~i~ities Code, provided tha~c if Feder~l ~unds ~or main.tenance
