HomeMy WebLinkAbout74-032WHEREAS, Resolu~tion No. 72-62 was passed and adopted by the Butte County Board of Supervisors on Apri1 4, 7.972, pursuant to the provisions of Chapter 20 of the Butte County Code to establish standards for subdivisions and land d.ivisions; and Wf~REAS, ~he Board of Supervisors desires to amend certain standards contained tt~erein pertaining to roads, sewage disposa~. and water supply; NOW, TFiEREFORE, BE IT RE SOLVED by the Butte County Board of Supervisors that part B of Article III of Resolutfon Noo 72-62 pertaining to road standards zn land divisions is hereby amended to read as follows;. Bo Land Divisfons 1. Construction stan.dards ~or access easements sha11 be as specified below, within the areas indicafied. ao Mountain Recreational Area and Rural Areao When a proposed land division is within the mountain recreational sub- division area (as shown on Appendix I of this resolution) or within any rural area (other unincorporated area outside the urban areas shown.on said Appendix I), the following construction stan.dards sha11 apply: (1) When any parcel containing less than forty (40) acres,or less than a quarter-quarter section, but not less than five (5) acres, is created, th.e planning for road alignments and grades to a County road sha11 be laid out to all parcelso No detailed right-o£-way engineering need be provided. Encroachmen~ permits sha~.1 be obtained and safe approaches to County roads shall be constructed. Access to ail parcels sha11 be traversable. _ . .... . . : ; - ~~~'-~ . RESOLiTTION AMENDING CERTAIN SUBDTV~STON AND LAND DIVISION STANDARDS AS E5'TABLISHED BY RESOLUTiON 72-62 (2) When a division resul~s in any parcel of less than five (5) acres but not less than two (2) acres, the road planning specified in subsection (1} above shall be provzde~, the access to all parcels shal~ be improved to Standard II RS';8-LD as contained in Appendix II to this resolu~ion, and the access shall be traversablea (3) When a division results in any parcel of less than two (2) acres, the road planning specified in subsection (1) above shall be provided, the accass to all parcels sha~l be improved to Standard III, RS-8-LD (~aving shall not be required if road is not to go into Count~:.maintained system and provided a road maintenance agreement appraved b~ Public Works Departmen~ is filed with County Clerk's o~fice,) as containad in Appendix II o£ this resolution, and the access shall be traversable. b, Urban Areas, When a proposed land division is within a~ urban a~ea (as shown on Appendix T of this resolution) ~he following const~uction standards sha11 be applied: (~) When any parcel con~aining lESS than forty (40) acres, or less than a quarter-quarter section, but not less than five (5) acres, is created, the planning for road alignments and grades to a County road shall be laid out to a11 parcels. Drainage 'The requirements for storm drainage facilities for land divisions shall be the same as for private unimproved road subdivisivnso In lieu of ineeting these requirements and when approved by the Board of Supervisors, the developer may satisfy the drainage requixements by doing each of the following: ao Paying to the County of Butte a deposit fee of no less than $100.00 per parcel, or such other greater amous~.t as may be determined by the Board of Supez~risors to be adequate, which fee shall be reserved for the cost o~ eventual const~uction of the required drainage facilities, and bo Providing a tempo~ary solut~on which will not caus e adverse effects on other property or on the County road system until the permanent drainage facilities are constructeda 3, Genera~ Prav~sions ao Notwithstanding the foregoiz~g, a traversable access to each parcel is sufficient in the following divisions: (1) A division creating only two parce~s, each of a net area of less than 0,37 acre or each incapable of ~urther divisions due to the permanent physical condition of the siteo (2) A division merely alterir~g the lot line on a previous parcel map and not increasing the number of parcelso (3) A division creating only two parcels for financzng purposes onlya (4) A private driveway division pursuant to County Code Section 20-23 (C)o bo Access shall be considered traversable if it is traversable year around, except during snow season, by a standard two~wheel drive autamobileo c. Access improvements required herein shall apply to both on- and off-site access easements and shall be constructed prior to recording of final parcel map, subject to the provisions of (d) belowo Nothing contained herein shall preven~ an applicant 3, from proposing to finance required on- and off-site improvements through appropria~e assessment dzstrict proceedingso do If an original parcel before division does not abut upon a Cotu~.ty road, on- and off-site access improvements to said parcel shall be either constructed prior to presenting the parcel map for recording, or, in the alternatzve, a performance bond and improvement agreement shall be provided in fihe manner and form required by Butte Gounty Code Sections 20-18 and 20-19o In addition, the provisions of Butte County Code Section 20-20 (A) shall be applicablea e. Sewage Disposal: 1. Subdivisions ao Public or Communit Sewer Systemso (1) When a subdivision is located within a reasonable distance of an existing, operating, and available public or community sewage system, and it is practical and teasible to sewer the proposed subdivision by connecting to said system, the subdivider s~aLi be required to sewer the proposed subdivision to said systemo (2) If it is not practicable and feasibZe to sewer a subdivision by connecting to an existing public or community sewer system, o~ if such system is unable to provide the subdivision with sewer service, the subdivider may provide for sewer service by the development ot a community sewer system with treatment and disgosal facilitieso When a subdivider proposes to develop suclz a community sewer system, he must: (a) Provide for ~he establishment of a public entity empowered and adequate to maintain and operate the systemo (b) Obtain discharge requirements from the Regional. Water Qua].ity Co~txo~. Boardo (3) Sewer mair~s within a subdivision to be sewexed by connecting to a public or community sewer system shall be a minimum o£ 6-inches in diameter and shall be of either vitrified clay, cast ixont, or other material approved by the Director of Public Works, The joints may be either be11 and spigot or an approved rubber seal type packing, Placing of sewer pipe, including excavation and backfill, shall be in accordance with Appendix III of this resolutiono Manholes Snaii be spaced no tarther apart than 350 5. feeta Maniioles sha11 be a minimum of 48-inches in diameter and sha11 be of precast concrete and built ~n accordance w~th Appendix ITT of this resolutiono All service laterals shall comply with the Uniform Plumbing Code, iatest edition, and shall have a minimum slope o~ one-eighth inch per foot to the trvnk sewere Sewer clean out "Y" laterals and other appurtena~~es sha11 be as shown in .P.ppendix III of this resolution. (4) Gomplete plans and specifications including design criteria prepared by a registered czvil engineer sha11 be submitted to the Department of Public Works and the Department of Pub~ic Health for approval prior to connection to or construction or installation of sewers, sewage distribution, disposal or treatment facilities in a subdivision. All connectzons to, construction or installation of such facilities sha~l be in a~cordance with such approved plans and speczfzcationsa b. Individua~ Sewage Disposal Systems, (1) If public or community sewer service is not ~rovided pursuant to subparagraph a, subsections (1) or (2) above, individual sewage disposal systems may be pexmitted, provided that the proposed subdivision meets the minimum criteria set forth in Appendix VII of this resolutiono (2) When individual sewage disposal systems are proposed, t~e subdividar shall have percolation tests and soil depth studies made under the direction of a registered civil engineer, litensed land surveyor or registered sanitarian and shall submit test data to the County Department of Public Health in the form prescribed by said departmento The type and number of such tests made sha11 be as directed by the said departmento In areas where soil cond~tions vary widely, such as the mountain and foothill areas, tests may be required on each and every p~oposed loto 60 (3) Minimv.m lot areas sha11 be established based an percolation tests, topography and soil depth as set forth in Appendix VII o~ this resolution. (4) Subdividers may be required to establish a public entity, or annex to an existing public entity, which has the authority to p1an, finance, construct, and maintain a sewage system and sewage treatment facilitieso Said public entity sha~l also have the authority to plan, finance, construct and operate any facilities necessary for the disposal of waste pvmped from any individual sewage systems in the proposed subdivision and to conduct monitoring and surveillance programs required for water quality control purposes. Establishment of,or axu~exation to, such a public entity may be rec~v.ired to protect the public health, sa~ety and welfareo Reasons justifying such a requ~re.ment inc~ude, but are not limited to, the following: to prevent water pollution or water quality degreda~ion, to prevent the creation ot health hazards or nuisance conditions or to prevent or mitigate other adverse en- vironmental eftects which could result from the use of individual sewage disposal systems. In evaluating such possible ecnriroxunental effects which could result from the use of individual sewage disposal systems, consideration may be given to the cumulative effect o£ the use of individual sewage disposal systems within the proposed subdivision and in other subdivisions, land dzvisions, developments or projects within the same drainage basin, 2o Land Divisions a. Public or Com[nu~nity Sewer Systems . Wfzen a land division ~.s located within a reasonable distance of an existing, operating, and avazlable public or community sewage system and it is gractical and feasible to sewer the pro- posed land division by connecting to said system, the land divider sha11 be required to request annexation to that system, b. Individual Sewage Di.spvsal Systemso When connection to an existing public or community sewerage system is not practical and feasible or ff the system is 7. unable to provide the land divisian ~ith sewer service, individual sewage disposal systems may be permitted, provided the minimum requirements established above in subparagraph I b, subsections (1), ~2) and {3) £or subdivisions a~e meto In such cases annexation to an existing public entity may be requixed in ~he same manner as specified above in subparagraph 1 b, subsection (4). BE IT FURTHER RESOZVED by the Butte County Board of Supe~visors that Appendix VII of Resolution 72-62 is hereby amended to read as indicated in the form thereof which is attached hereto and incorporated herein by this referencee ~E IT ~'URTI~R RESOLVED by the Butte County Soard of Supervisors that part B Section 2 of Article VI of Resolution Noo 72-62 d.ealing with water supply in Iand divisions is hereby amended to read as follows: 2o Land Divisions. ao Where the average resu~.ting parcel. size is torty (40) acres or more, no information on ~the availability of domestic water is required, b. Where any resulting parcel is less than forty (40) acres, or less than a quarter-quarter section, but not less than five (5) acres, a division shall be approved only if one of the followa.ng requirements i.s met: (1} The developer shows that water in sufficient quantiCy and acceptable fox domesti~ purposes is available. Tests may' be required by the County Health Department to determine the sv.itability of water for domestic purposes. The availability of water shall be shown. by one of the following methods: (a) By drilling at least one well within the axea of the land division at a location approved by the County Health Departmen~ which will produce a flow of not less than 3 gallons per minute if ~es~ed during the period from January 1 through Juz~.e 30 or not Iess than one and one-half gallons per minute if 80 tested during the period from July 1 through December 31e The well log and a statement from a licensed we11 driller certifying to the flows sha11 be submitted to the County Health Department before filing of the final map. (b) By providing evidence from a registered engineer or geologist that a spring exists on each such proposed parcel that wi11 produce the qUantities specified in subsection (1) abovea Such statement shall be submi~ted to the County Health Department prior to tilir~g of the ~zna~ map. (c) W'here the water supply to the pa~cels created by the land division is proposed to be furnished by the extension of service from an ex~sting water system, by furnishing a statement from the water pur~reyor stating that the purveyor is willing and able to supply water to the land divisiona Such statement shall be submitted to the County Health Department p~ior to filing ot the final map. The requirements of subsec~ions (a) and (b) above may be waived at the discretion of the County Health Officer in cases where past experience has shown that potable water is available in the area of the proposed land division, Neither the waiver of the requirements of subsections {a) and (b), the acceptance o£ data or statements submi~ted p~rsuant to subsections (a), ~b) or Cc) nor the approval of ~he map by the County of Butte in reliance upon such waiver, data or statements sha11 be, nor be construed to be, a guarantee by the Coun.ty of Butte that sui~able domestic water in sufficient quanti~y is available to the parcels created by the land divisiono (2) A note is placed on the final map as follows: "WATER: There is no avidence tha~ domestic water is availablee" 9. co Where any resultin,g parcel is less than five (5) acres and an i~dzvidual wate~ supply system is proposed, the division shall not be approved unless the developer shows that water in suf~icient quantity and acceptable ~or domestic purposes is avai~- ableo Tests may be required by the County Hea~t~ Department to determine the suitability of water for domestic purposes.
