RESOLUTION AND NOTTCE OF INTENTION TO ANNEX
TERRITORY TO COUIV:~Y SERVTCE AREA AND SETTING
FEIBLTC HEARTNG (LAF~ No, 74-7, Proposed
Ann~ation to County Service Area Noa 4)
WI-iEREAS, the Board of Supervisors of the County ot Butte
initiated pre~.iminary proceedings for the annexation o~' certain
described ~eerxitory to County Service Area No. 4 by passing,
adopting and ~iling with. the Butte County Local Agency Formation
Commission Resolution No. 74-4, and
WI~REAS, the Butte County Zoca1 Agency Formation Commissi.an,
after appropriate proceedings,a3opted Reso2ution 74-5 on February
7, ~974 approving said annexatxon and found, determ~.ned and
resolved as follows:
l, The exterzor bounda~ries o~ the ~erritory to be
ar~nexed are as described in Exhibit 'tA~~ a~~ached hereto and made
a part hereo~ by this referenceo
2, The territory proposed for axu,.exation is u.ninhabitec3,
3, 'That the following destinctive short-form designation
shall be used throug~out the proceedings: LA~C Noo 74-7,
Proposed Annexat~.on to County Service Area Noe 4~0
WHEREAS, the reason for this annexation pxoposal is to
pravide maintenance and servicxng of r3rainage facilities and
construct7nn, operation, replacement, maintenance and repair of
sewage co~.lection, transportation and disposal systems, for the
described territory.
NOW, THEREFO1tE, BE IT R~SOLV'ED as ~ollows in compliance
with the requirements of the District Reorganization A~~ and the
dete~mina~ions of ~he Loca1 Agency Formation Commission:
1, It is the intention of this Board to ann.ex the territory
hereinbefore described to County Service Area No, 40
2. A publzc hearing sha11 be held on this proposed
anneXatipn orl April 16, 1974 at 2:fl~ P,m, in
the Bpard of Supe~~r'isors Room, Butte County Administration Buildin~,
Orovil~le, Cal.iforniao
3, ,A.ny interested person desi.ring to make written ~rotes~t
agai.nst ~he proposed ax~zlexation shalJ. do so by signed, written
conununication filed w~i~h the Clerk of the Board of Supervisors at
the County Administration Building, Oroville, California not latar
than the hour set fo~ hearing, Anys.ich written protest by a
landowner shall contain a description safficient to ident.ify the
land owned by him; a protest by a voter shall contain tha residential
address of such votero
4o The C1erk zs directed to certify ~o th.e passage of this
resolution; to have it published once each week for twa successive
weeks in the paradise Post_ _~___~ ~, the first such
publication to be at least I5 days prior ~o the date of hea~ng;
to post a copy of this resolution on the balletin board outside the
Board of Supervisors room, su.ch. pasted notice to commence at least
15 days prior to the date set for hearing and continae until th.e
time of the hearing; an.d to mail a copy of this resolution,
postage prepaid, ~o each land owner owning land in the territory
proposed for annexation and to aJ.l persons and counties, cities
or districts which have h.eretoforefi3.ed a wri~ten request for
special notice with the Clerk, such mailing to be completed at
least 15 days prior to the date of the hearingo
