HomeMy WebLinkAbout74-044RESOLUTION CANVASSING VOT~S CAST AND ASCERTAINING AND DECLARING RESU~TS OF SPECIAL BOND ELECTION IN BUTTE COUNTY SERVICE AREA NO. 26 WHEREAS, the Board of Supervisors of the County of Butte has duly passed and adop~ed on December 18, 1973, Resolution No. 73200 calling a special bond election in Butte County Service Area No. 26 on March 5, 197~, for the purpose of submitting to the qualified electors thereof the measure hereinafter specified; and W~IEREAS, notice o~ said election was thereafter du~y given as required by law and by said resolution, as more fu1~y appears from the affidavits on ti~e with this Board of Supervisors; and WHEREAS, it appears that said election was duly held in accordance with law and with said resolntion on March 5, 1974, as aforesaid,that the polls fo~ said election were kept op~n during the time required by law; and that said election was held and canducted, and the votes therea~ received and canvassed and ~he resu~ts thereof ascertained, determined and declared, all as provided by the laws of the State o~ Ca~ifornia and by said resolution, and WHEREAS, on this date this Board of Supervisors met at its usual meeting place and has canvassed the returns of said election as reguired by 1aw, and the result of said canvass is found to be as hereinafter stated and set forth; NOW, THEREFORE, BE IT RESOLV~D BY THE BOARD QF SUPERVISORS OF THE COUNTY OF BUTTE, AS FOLLOWB: ' 1. ~he foregoing reci~als are, and each of them is, true and correct, and this Board so finds and determines. 2. At said election held on Tuesday, r2arch 5, 1974, the following measure for incurrinq bonded indebtedness was submitted to the qualified elec~ors of Butte County Service Area No. 26 and the number pf votes cast and ~he number of votes aounted for and against sazd measure (including absentee votes) were as ~o~lows: Total Total Tota1 Ballots Total Votes Votes Spoiled and Votes "YES" "NO" Not Counted Cast NIEASURE : Sha~.l Butte County Service Area No. 26 incur a bonded indebtedness in the sum ofi $1,500,000.00 for the purpose of the acquisition, construction and compl.etion of faciZities for the collection, treatment and disposal of sewage of Butte County Service Area No. 26 and its inhabitants, comprising ~reatment facilities, outfall lines, intercepting lines, co7.lector sewers, trunk lines, pipes, pumps, machinery, lands, easements, rights of way, and other works, property or structures, use~ul or necessary for the collection, treatment or disposal of sewage of said Butte County Service Area No. 26 and its inhabi~.ants? 736 96 _ 0 832 3. Resolution No. 73-200 calling said election provided ' that for the purpose of said election ~he county service area constituted three (3) special bond election precincts, and tha~ the number of votes cast'in said precincts for and against said measure was as follows: YES NO SPOILED TOTAL MEASURE 736 96 0 832 4. Al1 absent voter ballots have been duly receitred and canvassed in time, form and manner as required by law, and the result of the absentee vote for and against said measure is as follows: 2. That more than twao-thirds of all of the votes cast at said election were in favor of said measure and authorized the incurring of a bonded indebtedness for the purpose set forth therein and that said measure passed. 6. The C1erk is hereby ins~ruc~ed to enter this resolution on the minutes of this Board of Supervisors as a statement of a resul.t of saicl election.
