RESOLUTION AUTHORTZTNG ACQUISITION OF REAL PROPERTX BY
EMINENT DOMAIN NECESS~I.RY FOR THE CONSTRUCTIOi~I OF A COUNTY
HIGHWAY KNOTTN AS SKY47AY IN 'THE COUNTY OF BUTTE ~ STATE OF

SE IT RESOLVED by the BOARD OF SUPERVISORS of the County o~ Butte,
State of California, that said Board finds and determines and E~ereby declares,
as folT.ows, to wit;
1. That public interest and necessity require Che acquisition, const-
ruction and completion by the County of Butte, of a public improvement? nameiy
a County Highway known as Skyway~ in the County of BuCtie~ Statie of Galifornia,
2. That public interest and necessity require the acquisition for said
, improvement of the real property, or interest in the rea~, property hereinafter
descx9.bed, together with all improvements situate thereon, and it is hereby
found and detezmined that the conskruction of a County Highway is a public use,
authorized by 1aw, and that public interest and necessity require the con^
stxucti.on o£ said improvements and the acquisition of said real propert}* here^
inafter descri.bed, and a7.7, z.mprovements situate thereon.
3. Said proposed publfc impx'ovement i.s p7.anned a~,d located in. a manner
which will be most compatible with the greatest pub~ic good and Che leasC
private injury.
~. That tE~e County Counsel of the County of Butte is hereby authorized
and empowered as follows:
(a? To acquire~ in Che name of Che Coun~y of BuCte~ a fee simple esCate
or such necessary inCeresrs in and Co Che hereinafter-described rea7 property~
or interesti in real property~ and all improvements thereon by condemnaCion in
accordance with the provisions of the Streets and Highways Code, Code of Civi1
P~'oceduxe and the Constitution of the State of Caiifornia, rela~ing to eminen.t
domain~ to autihorize the Auditor to pay from County funds the costs and conszd-
eration for said acquisition, and the Auditor is authorized to make such pay-~
ment on suthorization.

(b) To prepare and prosecu~e for the County of ButCe such proceedings
in the proper court having jurisdic~fon thereof~ and make such deposits'from
County funds for fees and costs as are necessary for such acquisition.
(c) To make application to said court for an order fixing the amount
of security in the way of moneys deposited as said court may direct, and ~or an
oxder permitting the County of Butte to take immediate possession and use of
said real property, oz interests, or improvements in said real property, as a
right of way for a public highway for public use.

(d) To make deposit o~ such security out of proper funds under the
control of the County of Buttie~ in such amounts as fixed and determined and in
such manner as sa~d court in which condemnation proceedings are pending may
direct~ and the Auditor is auChorized to make said deposit immediately upon the
I court making said ordex.
5. The real praperty, or interest in real property, and/or improve~
ments thereon, which the CounCy of Butte is, by this Resolution, authorized
to acquixe for said public improvements in fee simple~ is situate in the County
of Butke, State of California, more garticular~y described in Exhibit ~~A'~~
attached hereto and made a part hereof by re~erence.
PASSED AND ADOpTED by the Board of 5upexvisors of the County of
Bu~te, State of CaYifornia at a regular meet~ng thereof on the 26th day
o~ Mar~h , 1974, by the following vote;
