A I2ESOLUTION APPROVING REVISED RATE SCHEDULE OF CA~V
LIC'~N~E FOR PO}.2TIO1~F OF BUT'T.E COUNTY SURROUNDING
i9ND CONTIGUOUS TO CIT'Y OF C~IIt;O
WHEREAS, pursuant to Resolution No. 69-49, State ~'V
Cable, a California corporation, is the successor grantee and
assignee of the non-exclusive Business License to construct, operate
and maintain a communa.ty antenna television system ~CATV) in that
portion of the Gounty of Butte surrounding and contiguaus to the
City of Chico, State of California, as set forth in that certain
Business Licezse, adopted on S'eptetnber l, 196~, as amended from
time to ~eilne; and
WHE1tBAS, said Business License was issued on a11 of the
conditions set forth in the Code of the Ci~y of Ghico, California,
1958 edition, as amended, in certain designated sections thereof,
together with certazn designated sections of C~iico City Ordinance
No. 794, with. appropriate substitution of language, which City Code
and Ordinance Sections were incorporated therein by reference as
Conditions of said Business Zicense,and as further amended by
Resolution No. 70-86 adopted on June 16, I97fl; and
WHEREAS, pursuant to ~ection 3 of said Ordinance No.
794, as amended, an.d Article II, Section ].0:9.30(b) of the Code of
th e City of Ghico, all as incorporated in said Business ~icense,
S~~ate TV Cab]e as Grantee has submitted to ~he Butte Couxaty Board of
Supervisors ss the franChisix~g authority a revised rate schedule
identical to the re~rised arate schedule adopted for the Ci~y of
Chico, and pro^vidir~g the amovnts o£ al1 rates and charges to be
made for all services to be rendered by it to its cus~eomers;
WHEREAS, on April 16, 1974, following timely publieation
and posting of no~ice of hearing, the Board o~ ~u.pervisors held a
public hearing on the submitted rate schedule to be revised;
WHIItEAS, at the hearing the Board of Supervisors con~
sidered ~he proposed revised rate schedule and conditions thereto
and found the revised rates and charges and conditions to be
reasonab~e; and
, WHEREAS, formaZ approval of ~he submitted rate schedule
by resolution of the Board of Supervisors would be in conformity with
~ection 3 of Ordznance No. 794, as amended, and Article TT, Section
10A.30(b) of the Code of the City of Chico, all as incorporated in
said Business License, and would comply with the rv.les and regulations
adopted by the Federal Communications Commission, and accordingly
would be appropriate.
NOW, THEREFORE, BE IT RESOLVED by the Board ot 5upervisors
of the County of Butte, that pursuant to the provisions o~ said
Business License, the Board of ~upervisors of the County of Butte
hereby approves the revised Rate Schedule and conditions thereto,
aTl as set forfih in City ot Chico Resolution No. ~33~~3-74 ,
including the rate schedule attached thereto as an exhibit, true and
correct copies o~ rahich are attached hereto as E~ibits 7°A" and
"B"`and incorporated herein by reterence as if set forth at Iengtho
' PASSED AND ADOPTED by the Butte County Soard of Super-
visors this 16th day of Apri1, 1974, by the following vote:
