WHEREA~, the Board of Supervisr~rs had originalZy adopted
guidalines tor implementation of the Environmen.ta~ !Qual.ity Act
in Resolution 73-~9, and
WHEREAS, the ~tate has adopted amendments to its guide-
lines wk~ich require some additions to the Counfiy guidelines.
NOW, THEREFORE, BE IT RESOZVED by the Board of Supervisors
that the procedures attached hereto as Exhibit "A" and adopted
puxsuant to Public Resources Code Section 21082 as the objectives,
criteria and procedures to implement the California Envixonmental
Qual.ity .Act o~ I.970, consistent with the guidelines adopted by the
~ecretary of the Resources Agency pursuant to Public Resources
Code ~ection 21083.

ENVZRONMENTAL UALITY ACT OF L970
~. . OBJECTIVES .
The objec~~.ves of these pracedv.res are to impJ.ement the
Cal.ifflr~ia Envz~onmen~.a~. Q~ality Act of 1970 (CEQA) as amended
~ ~ and to e~.sure tha~ consi.deration is given to th~ environmenta~.
e~fects of pro~ects which are subje~t to CEQA, ;An
Environmental 7mpact Report is an info~ma~iana~~ document which,
when fu~ly pre ared in accordance with CEQA and these
Guidelxnes, wi~l. inform pub~ic decision-makers and the general
publzc of the environmental effects of projects they propose
~ to carry ou~ or approve. The EIR process is xntended ~o .
. eriable publ~.c agenci.es to evaluate a pro j e~t to c~et~rmine
whether.it may have a significant eff~c~ on the env~ronment,
to examine a nd 3nstitute methods o~ reducing adverse impacts,
and ta conszder alter.natives to ~he project as proposed.
These things must be done prior to approval or disapprova~
~ of the praject. An ETR may not be usec~ as an ins~rumen~ to
ra~iona~ize appraval of~a project,.nor do indications of adverse
impact, as enunciated in an E~R, require tha~ a project be
disapproved. Whi7.e CEQA requires ~hat major consideration be
given to preve~txng environmental damage, it is recognized
that publ~c agencies have obligations ta bala nce other public
ab,~ectives, ~nc~.ud~ng.economic and social factors in determinzng
wh~ther and how a pro~ect ~shoul.d be approved. Ecanomic
information may be znc~uded in an EIR or may be presented in
whatever ~orm ~he agency desa.res. The County re~a~ns its ~
e~isting au~.hority to ba~ance envirQnmental abjec~ives wi~.h
ecoriomic and sacial ab~ec~ives and to wexgh the various long
term and short term C05'~5 a nd benef~ts o~ a project ~.n mak~ng
the decision to approve or d~sapprove it,
2. DEFINITIONS.
The definitxons cor~.ta~ned in CEQA and the regc~lations af the
Ca~.ifornia Resources Age.rxcy implem~nting CEQA shall be app].icable
in construzng a nd applying these proced~.res.
3. EMERGENCY PROJECTS.
The f ol~owing emerger~cy pro j~cts a re exe~np~ f~o~n the
r~quirements of CEQA,a~d ~a E~R a,s required. ~
(a) Projects unde~taken, ~arried out, or appraved by a~.
publ~.c ag~ncy to maintain, repa~r, restvre, demolish
or replac~ p~operty or'facilities damaged or destroyed
as a re5ult of a disas~er in a disaster striken area
~ in which a sta ~~ of eme~gency ha s been procla imec~ by
the Gove~no~ p~rsuant ~o Chapter 7{commencing w~~h
Section 8550} of Div~sion ]., Tit1e 2 of ~he Government
Ca de .
(b) Er~erge~cy r~pairs to publ.ic service facili~ies
necessary to maxntain service.

4. LEAD A~ENCY.
Where a proj~ct is to be carried ou~ or approved by more
than one public agenc~ only one public agency shall be
responsible far prepara~ion af enviranme~tal doc~ments and
~,t wi~.~ be the Lea d Agency. 5uch environmental c~ocuments
wxl~ be prepared by the Lead Agency i~.consultatian with al~
othe~ responsible agen~ies. The Lead Agency's environ~nen~al
documents sha11 be the ~nvironmentaZ docurnentation for a11
responsibl~ ag~ncies, 5uch responsib~.e agencies sha~l consider
the Lead Ag~ncy's EIR or r~egative decZaration prior to ~acting
upon or approving the proj ects, and they shall ce~tify -~hat
their decision-making bodi~s have reviewed and considered the
informat~.on contained in them. . ~
~ (a} T~ ~he project is to b~ carr~.ed aut by a publi~ agency,
the Lead Agency sha~1 be th~ public agency which
proposes to carry out the p~o,~ect. ~
(b} If th~ pro,~ect ~.s to be carried out by a nongovern- ;

(c) Where more ~han one public agency equal~y meet the

which is to act first on ~he project in ques~ion.

When app~ication is made to the Goun~y af Butte, ar any
depar~ment thereof, as th~ Zead agency, frr approval af a
private pro~ec~ (as defined in ~.4 Califo~n~a Administrative
Cod~ Sections 15037(a)(2} and {3} and I.5Qf2) the ~ollawing
pracedures sha3.~. b~ follo~red, in accordance with the flow
~hart a~tached hereto as Appendxx A. ~ ~

A, The department w~th which the applica~ion has been
fi~ed shall determine wh~ther the applicatian is for.a
rninis~erial act~.vi~y or ~or an ac~ivity qual~.fying far a
ca~egorical exe~p~~.on, which activit~.es and ~xemptions. are
list~d on a~tached l~ppendix B. ~f the app~icat~on is for a
ministerial actxvity or an activity which is categorically
exemp~, no env~.ranmen~a~. a.mpact re~ort (E~R) ~s required, and
regular processing o~ th~ app~.ication may cont~.nue without
fu~~her environmental revi~w pc~rsuant to these pro~eduares.
B, If the activity in quest~on is nat mxnister~a~
and is not catagorica~ly e~empt, the departm~nt shall notify
the app~.xcant ~o app~.y a~ the Planning Department, 7 CQUnty
Cerit~r Drzve, Qrovil.~.~, Cal.ifornia, for review of th~ pro~eCt
by the Env~~onmen~al Revzew Camanittee (ERC), consist~ng o~'
one member each from ~he Planning Department, Health Department
and Public Works Department. The a~Zication for such. r~v~.ew
shall be a ~compan:~ed by a f ee of ~7:~.00: : .

Major issues raxsed when approval a~ ~he pro~ect wauld be at.

comments m~st be addressed zn detai~ in the attachment, whzch
shou~d g~ve reasons why specific comments and suggestions
were nat accepted and list factars of overri~ing ~~portance
wa~ranting an override of ~hese suggestions. Notwithstand~ng
the above provzszons, if al~ such comfnen~s.or suggestions
are adequat~ly,~dealt with in ~he draft ETR; the at~achment may
simp~y so state and identi~y the applicable sections of the
draft EIR. The final EIR shall consist of the draft E~R, a
copy or s~mmary af comments received pursuan~ to sections ~d
and S above and. the Plannzng Commission's ~attachmer~t. .
~ U, The determina~ion by the Plantt.~.ng Commission with ~
resp~ct to cert~ficat~.on o~ the final EIR shall b~ ~inal unless

W. After a decis~an is made on the p~aject, the
agency making the d~cis~an sha11 pr~pare a Notxce of Determi~ation
~,n the farm attached as Appendix E~nd f~~,e i~ with the County
C~,erk and Planning Department, inc~udir;g a sta~ement of over~
riding cons~deratian if adverse enva.r~nm~nta~. cons~quences have
been ~dentified, and ident~.fyxng the other inter~sts that
warrant-approval in its po~nt of view.

enactment and amendmen~ a~ zonxr~.g ordinanc~s inx~iated by the
Plar~n.ing Comm~.ss~.on or the Board of Supervisars,~ and ~he
