WHEREA.S, the County o~ Butte has traffic signals installed at
various locations in the County; and
WHEREAS, the County does no~ have adequate personnel or equipmen~
for the maintenance of such traffic sfgnals;
NOW, ~HEREEORE, BE IT RESOLVED that the State of California, Department
of Transportation, be requested to maintain said si.gnal. system aC an estimated
cost of $2,500.00 for the 1974-75 fiscal year.
BE IT FURTHER RESOLVED that the followi.ng "Save Harmless" provisions
is approved by Che Board in connection with such maintenance:
"I~ is expressly understood and agreed by the Coun~y that the
SCate of California and its officers and i.ts employees sha11
no~. be answerable or accountable in any manner £or injuries
to or ~he death of persons or for any damage ~o property re-
sulting from the operation of or the faiJ.ure to mainCain the
traffic signals.
"The County agrees to indemna.~y and save harmless the State of
California and its o~~zcers and employees from a11 suits,
actions or claims of any charactex brought as a consequence
of the operation o£ or the failure to maintain the traf~ic
signals."
BE IT FIIR~HER RESOLVED tha~ the Cov.nty will deposit su££i.cient funds
not to exceed $2,500.00 with the Department of Transpoxtatzon for the main-
tenance of said s~.gnals during the 1974-75 fiscal yeax.
