ItESOLUTTON AUTHORIZING EXECUTION OF HOLD HARMLESS
AGREEM~NT RE MURPHY SLOUGH PROJECT
BE TT RESOLVED that the Board of Supervisors of the County
of But~:e hereb~ approv~s the attached above-entitled agreement.
between th~ County of Butte an.d state RecLamation Board
and hereby authorizes the Chazrman of this Board to execute same
on beh~lf of the County of But~ee.

following circumstances:. ,
«f3EREAS, the Congress authorized a project of bank pro-
tection for the Sacramento River and its tributaries, subject to
securing assurances that one-third of th~ tota~ project cost would
be assumed b~ some agency other than the united States, that ~he
Uni~ed S~ates wouLd be held ~ree and harmless from damages due to
the construction wo~ks performed under fha~ pro~ecf, and that
prnject works would be maintained and ppezated ~n accordance wi~h
the.regulat~ons o~ the Secreta~y af ~he Army, upon compZ~fiion of
the work.; and
WHEREAS, the Legislature of the State of Cal.ifornia
authorized Board to give tl3ese assurances under the ~rovisior~s of
Sections 12649,1. and 12657 0£ the 4+Tater Code; and
ti?HEREAS, necessary funds wi11 be appropria~ed to enab].e
the S-cate to mee~ tl~e one-third local interest cons~.ructa,on con-
txibution in cannection with the project, subject ~o the Board.

other than the Board agreeing to assurne the ohligations of main--
taining and operating the•project and of holding ~he i3nite$ S~ates
and f.he State harmless fro~n c~amages; anc~. .

~ West, P~iount Diab7.o Base and. Meri.dian, Board will sub-
mit to ~oca1 Agenc~ fpr review and comment tl~e a.nitial
set of pzelim5.nar.y plans.zecezved by the.corps ot •
~Enga.neers ~o~ such work. Suc7i plans or such madsfied
plans as are available to the Board will he submitted
as soon as available and not less than thirty (30) days
prior to advertising such~work for bid'and sha11 be in
substantia~ conformity with Senate Documer~~ ~103, 86t1~
• Congress, 5econd Ssssion. FinaZ p~ans and,specifica--
tioris ~or such work sha11 be submi~ted to Local Agency '
for review and comment a~ I~east ten (10) daxs pra.or ~o

Loca1 Agency-to the Board shall be advisory in nature.
