provides that in small claims actions that:
"No attorney at law or other person than the plaintiff
and detendant shall take any' part in the filing or pro-
secution or defense of such litigation in the small claims
court." and,
WH,~REAS, California Governmexzt Code Section 23004 conters
upon the County ~he capac~.ty to sue an.d be sued, and
WHEREAS, the County is ttnable to appear except through a
natura7. person; and this Board des~.res to appoint proper representa-
tives to prosecute and de~end legal actions in. the sma11 claims
courts of this County.
NOW, THEREF0~2E, BE IT RESOLVED by the Board of Supervisors
of the Countiy of Butte as fol,lows:
1. That the fol.lowing Butte County offices are appointed
to represent the Coun.ty in, th,e small claims courts of the County:
(a) Butte Cotu~.ty Administrator
(b) Butte Coun.ty Sheriff
(c) Butte County Treasurer/Tax Collector
(d) Butte County Director of Public Works
2. 'I'hat the above-mentioned ofticers may designate an
emp].oyee from within his department, whose dutzes gi~ve him peculiar
know~.edge of the facts of the particular small c~.aims action, to
prosecute a~d defend such action~on behalf of the County.
