of Butte a cemetery known as the Forbestown Cemetery, which cemetexy
is described in Exhibit "A" and was historically utilized to inter
persons who resided in varzous mining communities of the County, and
WI-i~REAS, on ~eptember 10, 1974, this Board passed
Resolution No. 74-134 expressing its intention to declare the
said cemetery abandoned as a place of future interment and to
dedicate it as a Pioneer Memorial Park after publication o~ the
said resolution pt~rsuant to the requirements of Section 8826 0~
the Health and Safety Code and the holding of a pubiic hearing on.
the question; and
WHEREAS, the said resolution has been published pursuant
to Section 8826 of the Health and Safety Code and a public heari.ng
held on the question o£ abandonment of the Forbestown Cemetery and
ded.ication of it as a Pioneer Memorial Park; and
WHEREAS~ the said cemetery is not at the present time
being utilized to inter hur~an dead bodies and has not been so
uti].ized in excess o£ £ive years preceding this date; and
WHEREAS, the cemetery in its present condition endazzgers
the health, safety, comfort and welfare of the public.
NOW, THEREFORE, BE IT RESOLVED that the cemetery known
as the Forbestown Cemetery and described in Exhibit "A" sh.al~. be
and is hereby declared to be abandoned as a place of future
interment and is dedicated as a Pioneer Memorial Park to be main-
tained by the County of Butte so that it will not endanger the
