RESOLUTION AND ORATFt PRELIMZI~lARILY ADOPTING ENGIN$ER'S
itEPORT, SETTING PUBLIC HEARING AND CALLII3G FOR BIUS,
FIRLAND ACRES ASSESSMENT DTSTRICT, COUNTY OF BUTTE,
STATE OF CALIFORNIA
WHEREAS, on the 26th day of June, 1973, the ~oard of Super-
visors o£ the Coun~y of Butte, State o£ California, adopted its Reso-
lutipn of Intention fox the improvements and acquisitions in ~'irland
Acres Assessment District, County of Butte, State of Califo~nia, and
referred said impravements and acquS.sitions to CLAY CASTLEBERRY, Director
of Public Works of the County of Butte as Engineer of work for said
assessment district; and
WHER~AS, said Board of Supervisors directed that said
Engineer of Work make and file with the County Clerk of the County of
Butte, a report in writing in accordance with ~.he provisions and require-
ments of the Municipal Zmprovement Act of 1913 of the State of Cali-
fornia; and
WHEREAS, said Engineer of Work did, on the 30th day of
December, 1974, file with the County Clerk of the County of Butte, a
report in accordance with the said resolution, and said County Clerk
has presented tlze report to this Board for consideration;
NOW, THEREFORE, BE I~' RESOLVED by the Board of Supervisors
~ of the County of Butte, S~ate of Cali£ornia, and this Board hereby
finds:
].. That the report made and filed by the Engineer of Work
on the 3~th day of December, 1974, contains all of the requirements
provided £or said report by ttie provisions of the Municipal Improve-
ment Act of 1413, includi.ng {1) specifications; (2) plans and pro-
• fiies and estimates of cost; (3) assessment diagram and assessment;
(4) d'escriptions of easements and/or Xights-af-way to be acquired.

2. That said report, and each and every part thereof,
is suf€icient in every particular, and it is hereby determined ~hat
said repozt shall stand as the report for all subsequent proceedings
under said Municipal Improvement Act of 1913; and
BE IT FURTHER IZESOLVED that Tuesday, the i8th day of
February, 1975, at the hour of 2:00 o'clock P.M. of said day, at the
meeting place of the Board af Supervisors o£ the County of Butte,
loca~ed in the Butte County Courthouse, 1859 Bird, Oroville, Ca1i-
fornia, is hereby fixed as the time and place for hearing protests
with relatzon to the proposed improvements and acquisitians described
in said report; that any person interested in objecting to said
improvements and acquisitions, the grades to which the work wi~l be
done, or has been done, the ~xtent of the assessment district, the
assessment, or the engineer's estimate of cost and expenses, or any
other act or determination of the Board of Supervisors or the
Engineer of work of the assessment district may fiZe protest in writ-
ing with the County Clerk of the County of Butte at os before the
hour fixed herein for hearing thereon; and
BE IT FURTHER RESOLVED that the County Clerk of the County
of Butte~be, and he is hereby, directed to publish a Notice of Im-
provement pursuant to Sectian 6b66 of th~ Government Code of the S~ate
of California, th~ first of which said notices to be first published
at least twenty (20) days priar to the date herein set for hearing
of pzotests; and
BE IT FURT~ER RESOLVED that the County Clerk of the Coun~y
of Butte be, and he is hereby, further directed to cause Notices of
Improvement ta be posted on a1Z of the open streets within the dis-
~zict described in the Resolution of In~ention at not more than three
hundred feet apart on each street so posted in accordance with the
requiremenfis of Sections 1Q302 and 10303 of the Municipal Improve-
ment Ac~ of 1913; and

BE IT ~URTH~R RESOLVED that notices of the adoption of
the Resolution of Intention and filing of the Engineer's Report shail
be mai~ed, postage prepaid, to all persons owning real property to
be assessed whose names and addresses agpear upon the last equalized
assessment roll for taxes, or as known to the County Clerk. Said
nptices sha~l contain the ma~ters requized ~n Section 10307 of the
Municipal Improvement Ac~ of 19Z3 of the State of Galifornia.
BE IT FURTFIER RESOLVED that this Board hereby prelimin-
arily orders that the improvements and acquisitions described in the
Resolutzon of Tntention be had and done in accordance with the plans
and specxficatians and profiles far said work. The plans and speci-
fications with said report are hereby adopted as the plans, profiles
and specifica~ions for the ~oing of said work and improvements, and
said Board hereby orders that bids shali be rec2ived for the doing
of said work and improvements on the 22nd day of January, 1975, at
11:00 o'clock A.M, o~ said day. 5aid bids or proposals shall be deliv-
ered on or before 11:00 o'clock A.M. of the 22nd day of January, 1975,
at the office of the Directar of Public Works of the County af Butte,
7 County Center Driv~, Oroville, Caiifornia, which sazd tzme and place
are hereby fixed as the time and place of a public meeting at which
said bids will be publicly opened, examined and declared by the
Director of Public Works of the County of Butte. Said bids a£ter
being publicly opened, examzned and declared, wi11 be calculated by
the Engineer of Work, his report returned to the County Clerk and
the report of the results of the bidding and the calculations of the
. Engineer of Work will be repor~ed to the Board af Supervisors of ~he
County of Butte.

The Hoard o£ Supervisors zeserves the right to reject any
and all proposals or bids should i~ deem this necessary for the public
good, and also the bid of any bidder who has been delinquent or' un-
faithful in any former contract with the County of Butte.

I HEREHY CERTZFY that the foregoing resolution was duly and
regular~y adopted by the Board of Supervisors of the County o£ autte,
State of California, at a reguZar meeting thereof, held on the 30th
day of Deeember, 1974, by the following vote, to wit:
AYES: Supervisors Cameron Gilman, Ladd McKillop and Chairman Madigan
