AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA,
20NING A PORTION OF SAID COUNTY PURSUANT TO EXISTING
ORDINANCE NOSo 475 AND 522 OF SAID COUNTY
The Board of Supervisors of the County of B~htte, State of California, under and
pursuant to Ordinance No. X75 of said County, being. the tinning Enabling Ordinance of
said County as amended by Ordinance No, 522, DO ORDAIN AS FOLLOWS=
SECTION 1, The hereinafter described area situate in the County of Butte, State
of California, shall be zoned as an "'H-C" (Highway Commercial) District, as herein-
after described and subject to all of the restricted uses applicable to an "H-C"
District, said area so zoned being located in the unincorporated axes of Butte County,
particularly described as follows:
Property having frontage on the west side of U.So Highway 99E,
as identified by Assessor Parcel 38-2--23 as shown on the maps
of record and on file in the office of Butte County Assessor,
State of California, on March 5, 1962, to a depth not to exceed
five-hundred (500) feet from the west line of said U.S. Highway 99E.
SECTION 2. REGULATIONS FOR "H-C" DTSTRICTSo The following regulations sha11 apply
in "H-C" Districts: .. .
2.1 Uses permitted subject t~ plans approved by the Planning Commissions
a. Multiple dwellings and dwelling groups, subject to the height limit,
building site area, average lot width and yard requirements specified
for "R-3" districts.
b, Hotels, clubs and lodge hails, hospitals, sanitariums and clinicso
c. Retail stores and shops of alight commercial character and conducted
within a building, including appliance stores, banks, barber shops,
beauty parlors, book stores, cleaner or laundry agents and launderettes,
dress shops, drug stores, food stores, furniture stores, millinery shops,
professional offices, restaurants, refreshment stands, service stations,
shoe shops, storage garages, studios and tailor shops9 public utility
commercial offices and other uses which are of similar character to
those enumerated and which will not be detrimental or obnoxious to the
neighborhood in which they are to be locatedo
2.2 The following uses subject to securing a use permit i.ri each case:
a. A11 uses permitted in "Rt1" and "Rt2" districts.
b. Automobile courts and trailer courts.
c. Public and quasi-public usesa
d. Animal hospitals, .auto sales, dancing academies or halls, open-air retail
sales, theaters, pet shops, wholesale stores or storage, undertaking
establishments, used ear sales, used or secondhand goods ar}.d other usos
which are of similar character.

2.3 Building Height Limit: Forty-five (~5) feet,
2.4 Minimum Lot Width required: Twenty-five (25) feet.

2,5 Front Yard Required: None, except where frontage in a block is partially
in an "R" District, in which ease the front yard shall be one-half that
required_in such "R" Distrieto
2.6 Side Yard Required; None, except where the side of a lot abuts upon the
side of a lot in an "R" District, in which ease the abutting side yard shall
be not less than five (5) feet, and except where the side yard on the street
side of a corner lot abuts on an "R" District, in which case the side yard on
the street side shall be one-half the corresponding front yard required in such
"R" District.
207 Rear Yard Required: Twelve (12) feet, or five (5) feet adjacent to an alley.
2,8 Off-street parking: Off-.street parking area shall 'be approved in advance and as
required by the Planning Commission,
209 Fences, screen plantings,-etc.,- Fences, screen plantings and other obstructions
shall not exceed three (3} feet i.n height in front yards, nor six (6) feet in
height in any required rear or side yards. Tn the case of corner lots, fences,
shrubs, screen plantings or similar obstructions shall not exceed three (3? feet
in height within the sight distance area..
SECTION 3o All uses of land within the District not specifically authorized and per-
mitted under Section 2 are prohibitedo
SECTION ~o Fenalties for any violation of the zoning hereby imposed within the
District shall be as provided in .the Zoning Ordinanceo Ix- compliance with the provisions
of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date
become a supplement to and part of the Zoning F~.abling Ordinance,
SECTION $. This Ordinance. shall be and it is hereby declared to be in full force and
effect from and after thirty (30) days after the date of its passage, and before the
expiration of fiFteen (15) days after its passage, this Ordinance-shall be published once
with the names of the members voting for and against it, in the orov-ille
Mercury , a newspaper published in the County of Butte, State of California.
.PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of Califor-
nia, this nth day of dune 1962, by the following vote.
AYES; Supervisors Giles, Pittman, pryde, Steinegger and Chairman Alldredge.
