HomeMy WebLinkAbout75-029RESOLUTION NQ. 75-29 ~ RESOLUTZON AND ORDER APPROVTNG AP4ENDED ENGINEER'S REPORT~ ORDERING CdNS~RUCTION OF IMPROVEM~NTS AND ACQUISITTONS AND CONFIR~IING ASSESSMENT~ FIRLAND ACRES ASSESSM~NT DISTRICT, CO~NTY OF BUTTE, STATE OF CALIFORNTA WHEREAS, on the 26th day of June, 1973, the Board of Super- visors of the County of Butte, State of California, adopted its Reso- lution of Intention, as amended, in Firland Acres Assessment AistriCt, County of Butte, State of California, for ~he construction of improve- ments and acquisitions in said assessment dis~rict and referred said proposed improvements and acquisitions to the Director of Public Works pf the County of Butte, as Engineer of Work for said assessment dis- trict; an~ WHEREAS, on the 30th day of December, 1974, the said Engineer of Work filed an Engineer's Report, Assessment ~nd Assess- ment Diagram in accordance with said Reso~ution, and said Engineer's Report was presented to the Board af Supervisors of the County of But~e for considEration; and WHEREAS, on the 30th day af DecemF~er, 1974, the Boazd of Supervisors of the County of Butte preliminarily adopted said Engi- neer's Report and fixed Tuesday, the 18th day at the hour of 2:OD o'clock P.M. of said day, of the noard of Supervisors ot the County of Butte County Courthouse, 1859 Bird, Q~oville, and place ~or hearinq pro~ests with relatian improvements and acquisitions; and o£ February, 1975, at the meeting place Butte, located in the Cali£ornia, as the time to said groposed WHEREAS, pursuant to said Resolution hereinabove mentioned a Notice of Improvemenk was duly published, posted and mailed, giving notice of the time and place of hearing on said Report; and • -i- ~~~ ~~ WHEREAS, on the 18~h day of February, 1975, said hearing was held; and WFiEREAS, on the 18th day of February, 1975, ~he Board of Supervxsoxs pf the County of Bntte directed the Engineer of Work to ~ile an Amended Engineer's Repart; and WHEREAS, the Engineer of Work filed with the County Clerk of the Caunty of Butte, an Amended Engineer's Report; NOW, TIiEREFOR~, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, that this Board does hereby find, de~ermine and order as follows: 1. That ~he dis~rict benefited by said improvements and acquisitions and ~a be assessed to pay the costs and expenses thereaf, is more particularly described in the Resolution of Intention, as amended, hereinabove referred to and made a part heraof by reference thereto. Said Resolution of Intention, as amended, also excepts from the district to be bene~ited the area of all public streets, avenues, lanes, roads, drives, courts, places, public parks, and a11 easements and rights-of-way therein contained belonging to the public, and also all property owned by the County of ~utte, the Sta~e of Cali£ornia or the United States of Ame~ica, contained therein, now in use in the performance of a public function. 2. That the plans and specifications for the proposed improvements and acquisitions be, and they are hereby, finally adopted and approved as the plans and specifications to which said work shali be done as called for in said Resolution o£ Intentian, as amended. 3. That the Amended Estimate of Cost of the itemized and total estimated cost and expenses of the improvements and acquisitions, and of the incidental expenses in connection therewith, which said Amend'ed Estimate of Cost is on ~ile with the County Clerk o£ the -2- County of Sutte be, and it is hereby, finally adopted and approved as.the Engineer's total and detailed estimate of the cos~s and expen- ses of said improvements and acquisitions. 4. That the work and improvements ~o be made, as described in the Resolution of Intention, as amende~, and the Amended Engineer's Report on file with the County Clerk of the County of Butte are here- by approved, and all of the ~attiers contained in said Amended Engineer`s Report are approved and confirmed. The Board of Supervisars of the County of Bu~~e fur~her finds that the public convenience and inter- est require, and hereby orders the improvements to be made as described in and in accordance with said Resolution of Intention, as amended, and said Amended Engineer's Report. Reference to both the Resolu- tion of Intention, as amended, and the Amended Engineer's Report is hereby made for a more particular description of the work and im- provements herein approved, confirmed and ordered. 5. The Board of Supervisnrs of the County of Butte dnes hereby levy and apportion upon each and every lot, piece and parcel of land within the boundaries of tha assessment district the amount by which each vf said ~ots, pieces or parcels of land is benefited by the improvements and acquisitions. The amount of the assessment which is levied and apportzoned upon each and every lot, piece and pareel o£ land within the boundari~s of the assessment district is as shown on the assessment attached to and made a part o~ the Amended Engineer's Report adopted by this Resolution. The Board of Sup~rvisors of the County of Butte hereby finds and determines that each of said lots, pieces or parcels of land within the boundaries ot said district is bene£ited in the amount and in the proportion of the total cost of ~he improvemen~s and acquisitions, plus incidental expenses, which each of said lots, pieces or parcels of land has been assessed in said Amended Engineer's Repor~. -3- 6. Coliections of assessments shall be made by the County Treasurer of the County af Butte. 7. In tha event any surplus remains in the Improvement Fund after the comp~etion of the improvements and the payment of all claims from the Improvement Fund, said surpius shall be distributed in accordance with Section 10427 of the Streets and Highways Code. * * * I HEREBY CERTIFY that the foregoing resolution was duly and reguiarly adopted by the Board of Supervisors of the County of Butte, State of Califoznia, at a regular meeting thereof, held on the ~~ day of February, ].975, by the following vote, to wit: AYES: Supervisors Cameron, McKi.Ilop, Ri.chter and Chaa.rznax- I,add NOES: Supervisors None ABSENT: Supervisors 1`Iadigan CLA,RK A.
