L. 93-368 which provides for federal reimbursement of interim assistance to SST%SSP applicants, and WHEREAS the State has prepared a CONTRACT FOR THE INTERIM ASSIS'~ANCE PROGP.AM (CMS Control ~~14100) for such participation. '~his contract is entered into between the Department of Benefit Payments, State of Califoruia (keereinafter reEarred to as tfie State) and the County of Butite (hereinafter re~erred ta as the County), in order ~n assu~e the availahi].ity of assistance to meet basic needs of applican~CS for bane£its under Tit1e XVI of the Spcia7, 5ecurity Act pending eligi~hlity (hereinafter xe£etred to as the Interim Assistance Program), B. This contract is entered into pursuant to the agreement between the State of California and the Secretary of Health, Educatioa, and We].fare to i.mplement the provisions of U.S. Public Law 93- 368, and to Section 10553 of the State Welfare and Institutions . Code. C. For purposes of Chis agreement, the tern~ "initial payment" shall ' meaa the a~nount o~ benefi.ts determined by the Secretarp of Hea7.th~ T~ducation, and Welfare.to be payable to an eligible individual (i.mcluding retzoactive amounts, if any) at the time such an a.n- divzdual i.s ~irst detez~ni.ned to be eligib~.e under Txt1e XVI of the SociaZ 5ecurity Act but does not include any emergency advance payment authorized under Section 1633.(a)(4)(A) af the SociaJ. 5ecurity Act. IT. County Responsibilities The CounCy shall: A. Agree that there are no state mandated local costs in this contrac~ that reqnire reimbursement under Section 2231 af~the Revenue and Taxatian Code since participaCion b}+ the County is voluntiary. B. Abide bq the State regulations set.forth in Chapter 46-300, Section ~+6-337, of the Eligibility and Assistance SCandards of the Department o£ Benefit Payments Maaua7. of policie5 and Procedures, p~irsuant to the InCerim Assiseance Pro~ram. C. E. Require that each indi.viduaJ. who has o~ wi17. receive interim assistance sign a written agreement (SSP Form 14) executed by or on behalf of an individual. Such agreement sha1l provide at minimum: 1. That in consi@eration of the payment of i.nteri_m assistance by the County, the amount or parY. of such individual's initial paymant will be retained by the County for the pur- poses o~ reimbursing such intera.uc assistanca. 2. That after deducting t~e amount of such ~ezmbursement from. the initiai payment, the CQL3At}t shall pay any balxnce to such individual. withia 10 working days after receipt by the County. 3. mhat such in~ividual sha11 have the right to a hearing from the State respecting such apportionment o£ the initial paymenCS. ~'. Agree to reimburse the 5tate for any and all. cos~s incurred by the State as a result of Federal audit esceprions or claims made pertaining to the Countiy arising from ~he InCerim Assistance Program. Agree to indemnify, defead and save haxmless the State, its officers, agents and emp7.oyees from auy and alI contractors, subcon.tractors, materialman, iaborers and any o'~her person, firm or coxporat~.on furnishing or supplying work, services, materials or supplias in connection with the performance of this coaCxact, and from any and a11 claims aud losses accruing oz resulting to any person, • firm or corpozati.om who may be znjured or damaged by the Contractor in the performance of this contract. Tha responsibilities set forth in this clause shall remain in effect even if the Interim Assistance Program is cancell.ed by State or Federal action. H. Maintain responsibil3tq for drafting and implementing procedures for carrying our tihe Ineerim Assistance Program at tihe Countiy 1eve1. III. State Responsibilities The State sha11: A. Maintain responsibility for conducti.ng any negoti.ations wa_th the U.S. Depaxtmetit of Health~ Education, and Welfare pursuant to this agreement. D: Provide fair fiearings for recipients as set forth in the regulations reEerenced in Seetion II B of this Contract, above. IV. Ad~iaistrativa Costs Neither the County nor the State, in perform~ng ~heir funetions and duties under this Contract, shali pay to the other any costs of admiaist=atioa incurred by the other. V. General Provisions A. Bo~h partiies shall camply with any regulations and pxocedures £or maintaining confidentiality of general assistance or general rel3ef af the,County. Furthezv~oze, all in£ox~a.ation concerning SS~/SSP applicants and xecipients identi.ty or the amount of grant sha11 be confidetttial. Can£a.dentiality sha.ll be maintained unlesa written consent of the applicant or recipient has been obtained, except that a.nfaxmation map be shared with government agen,e~,es concera.ed with thP•admiaistration of this program when said informa~ion zs necessary for adminisCration. Tn regard to S5I/S5P app~.xcants and recipients, the confidentiaiieq provisions of Section 10850 0£ the Welfare and InstituCion Code shall appiy. B. This Con~ract may be amended at any time by mutua]. comsent in writing oF tihe partiies heYeto. C. Either party may termi.nate this Contract by 30 days notice to the other partp. Tf this Contract a.s tarminated in any manner, ~.n~iua~.g non-renewal, the reporting requirements and audit exception respon- sibilities provided for in th3s Comtzact sha11 apply. Furthezmore, if the contxact a.s ~erminated, the Countp shall continue to process ail cases fox whi.clz the.written recipient agreement descxibed in Section TT F of this Contract has been obtained. D. This Contract shall begin on February 18, 1975 and end on.June 3f3, 1975. It will automatically be renawed €or a perio~ of one year following June 30, I975, through June 30, 1976, unless either party elects to terminate as provided in V G above. E.
