DETERMINI~tG THAT THE PUBi,IG COIVVENIENCE AND NECESSITY REQUIRE IMPROVEI~ENTS AND ACQUISITIONS TO BE MADE AND PAID FOR BY SPECIAL ASSESSMENTS, AND (2) DE~'EI2MZNING TTi~1T THE SPECIAL ASSESSN3ENT INVESTI- GATI0IQ, LIMITATION AND MAJORITY PROTEST ACT OF 1931 SHALL 1~T~T APPLY TO PROCEEDINGS THEE2EFOR. AIfiEREAS on March 18, 1975, this Board adopted RESOLUTION Np. 75-50 (1) Declaring that Public Convenience and Necessity Require Impravements and Acquisitions in Lassen Avenue Assessment District No. 1, and (2) Setting Time and Place for a Hearing Respecting the Public Converiience and Necessity for said Improvements and Acquisztions, and WHEREAS, this Board set April 22, 1975, in said Resolution No. 75-50 as the date for hearing all persons interes~ed in tlie matters con~ained in said Resolution No. 75-50, and WHEREAS, the Clerk of this Board has filed his affidavit° showing that on April 4, 1975, he mailed a notice to each property owner in said LASSEN AVENUE ASSESSMENT DTSTRTCT N0. 1 stating the time and place of a hearing on the matte~s contazned a.n said Resolution Na. 75-50 and containing a11 other matters this Board directed the Clerk to include in said notice, and ' WHEREAS, the County Su~veyor-Direc~or of Public Works has filed his affidavit showing fchat on March 25, 1975, and! -i- through April 4, 1975, he caused notices to be posted on the ` streets in said LASSEN AVENUE ASSESSMENT DISTRICT N0. ~ stating the time and place of a hearing on the matters contained in'! said Resolution No. 75-50 and containing all other matters ~his Board directed sa~d County Surveyor-Director of Public ' Works to include in said notice, and WHEREAS, nn April 1 and Aprzl 2, 1975, the Cierk duly ; published in The Chico Enterp~~se-Record a notice stating the time and place of a hearing on the matters contained in'' said Resolution No. 75-50 and canta~nzng all other matfiers this Board directed the Clerk to include ~n said notzce and an affidavit of the said The Chico Enterprise-Recvrd has been filed showing said publication was done on said dates, : and WHEREAS, this Board has heard alI persona so objecting!' tha~ desire to be heard and has considered al1 such objections~'. N~W~'THEREFORE, ftESQLVED SY THE BQARp OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFpRNIA: 1. That this Board finds that each of the recitals stated above is true. 2. That this.Board finds and determines that the public : f convenience and necessity require that the County of Bu~~e construct the .improvements that are described or referred to'! 3 in Resolution No. 75-50 adopted by this Board on March 18, 19'75, in and adjacent to ~he area in ~his County that this Board has by its Resnlution No. 75-50 designated LASSEN AVENUE ASSESSMENT DIS~RICT NO. l, and this Board fur~her finds' and determines that the public convenience and necessity reguire -2- . _ _ ,. , ~ - . . ~~~ ~~ that the County of Butte acquire all rights of way, places,' and properties necessary for constructing said improvements and that th~s Board determines that said work and improveme~ts ~ and.acquisitions sha11 be paid for by special assessments levied on lands i.n said LASSEN AV~NUE ASSESSMENT DISTRICT NO. 1 and that ~his Soard determines that none of the provisions of the Special Assessment Inves~igations, Limitation and Majority Protest Act of I931 shall apply to ~he proceedings wherea.n ' said work and'a.mprovements are done and said acquisitions are made and the special assessments therefor are levied. 3. That this Board determi.nes that the work and improve= men~s and acquisitions and special assessments ~herefor and' al1 proceedings for the same shall be done pursuan~ to the ~: terms and provisions of the tmprovement Act of I911. 4. That this Board hereby denies all objections f~.led~ ; and presented respecting the matters contained in said Resolution No. 75-50. ~ 5. That this Board hereby directs the County 5urveyor= : Directar of Public Works to prepare and to present to this '' 3 Board, or to obtain and present ~o this Board where required ~ by law, plans and specificatians for doing said work and constructing said improvements together with careful estimate~ of the costs and expenses thereof.
