hareby dec~ares, as follows, to wit:
1, That publie interest and necessity require the acquisit~on,
construction and completion by the Coun~y of Butte, of a public
improvement, namely, a county highway known as Pentz-Magalia Highway
in the County of Butte, State o~ California.
2. That public interest and necess~ty require the acquisit~on
for said ~mprovement of the real proper~y, or interest in the real
property hereinafter described, together w~~h all impzovements
situate thereon, and it hereby tound ~n.d de~ermined that the construcW
~ion of a county highway is a public use, auChorized by law, and that
pub~ic interest and necessity require the constructxon of said
improvements and the acquisition of said real prope~ty hereina~ter
described, and all impzovements situate thereon.
3. Said proposed public improvement is planned and located
i~ a manner which will be most co~patible with the grea~est public
good and the Ieast public injuzq.
4. That the County Counsel of the County of Butte is hereby
author~zed and empowered as fol~aws:
,(a) To acquire, in the name of the County of Butte, a
fee s~mple estate or such necessary interests in and to the herein~
after described real pxoper~y, or interest in real property, and all
improvements thereon by condemnation ~n accordance with the provisions
of the Stree~s and Highways Code, Code of Civil Procedure and the
Constitution of ~he State of California, relating to eminent domain,

BE ZT RESOLVED by the ~oard of Supervisors of the Coun~y of
to a~thorize the`auditor to pay from county funds the costs and
conside~a~ion fo~ such acquisition, and the auditor is authorized
~o make s~ch payment on author~zatxon.
(b) To prapa~e and prosecute for the County of Butte,
such proceedings in the proper court having jurisdiction thereof, and
make such deposits ~ro~ Cou~~~ funds far fees and costs as are
necessary for such acquzsitxon.
(c) To make app~ication to said court for an order
fixing the amour~.t of security in the way of moneys deposited as said
Court may direct, and for an order permx~tzng the Covnty of Butte to
take immediate possession and use of sai~ rea~ property, or interest,
or improvements in said real property, as a right-of-way for a public
highway for public use.
(d) To make deposit of such security out of proper funds
under the con~rol of the Covnty of Sutte, in such amounts as fixed and
determined and in such manner as said court in which condemnation `
proceedings are pending may direct, and the Auditor is authorized to
make said deposit immediately upon the court making an order.
5. That real property, or inCerest in real property, and/or
improvements thereon, which ~he County of Butte is, by this resolution,
authorized ~o acquire for said public imp~ovements in fee simple, is
situate in the County of Butte, State of Cal~fo~nia, more particu~arly
describe~ in Exhibit "A" attached hereto and made a part hereof by.
reference as if set forth in fu11.
