RESOLU~'~~N REQUESTING GRANT BY THE STATE OF
CERTAIN ~tTGFiT-OF-WAYS FOR COUNTY ROAD PURPOSES
WHEREAS, the County of Butte wishes to construct a
road along the eas~ side of Route 70 between Baggett-Marysville
Road and Georgia Pacific Way, and
WI~EREAS, ~he State owns a certain portion of the land
over whzch said road ~aould cover, and
WHEREAS, ~his Board is in receipt of a le~ter dated
June 2, 1.975 fxom ~he Department of Transportation and signed by
R. A. Winton, Deputy Dis~ric~ Director which contains cer~ain
conditions, which 1er~er is attached hereto as Exhibit "A" and
incorporated herein as if set forth in fu11.
~TOW, THERLFORE, be it resolved by th.is Soard:
1. That the State is respect£ully reqt~.ested to grant
the Goun~y of Sutte the necessary riglzts-of-way subject to the
conditions set forth in Exhibit "A".

GentZemen:
We have reviewed and tenta~irrely approved the proposa~. to convey
portions of Sta~e right of way to the Co~anty to accommod.a~e con-
struction of a frontage road along the east side of Route 70
be~ween Marysville Road and Ge:orgia Pac3.~'ic Way. Fina1. action
on thi.s req~zest will require review and approva7. of the Director
of Public Woxks and wi~.l require two or three months. We are
prepar5.ng th.e necessary paper work to transfer th.is r~.ght of way.
As outlined in our letter dated Apri1 15, 1975 tv Ron McE~.xoy
of Cook a,~d Assoeia~es (copy to Clay Cas~leberry), ~he right of
way transfer would be contin~ent on several conditions.
. A11 construc~ian would be ~erformed at no cost
to the S~ate. ~
. Uniform s~.de slopes would be constructed between
the ~tate highway and the proposed county xoad.
. The existing freeway ~ence would be removed and replaced.
. All necessary culverts and drainage faci.lities would
be installed.
. The P.G.&E. nowex ~ine along ~Yie east side nf the
highway would. be relocated.
, An encroachment permi~ application would be submitted
to the district o~'fice ~'or review and approval of a1J.
construction operations within the existing State
right of way.
