NOW, THE~~'OR~, B~ IT 12~SOT~VED by this Board: 7., '~'na~ tl~is Board is in strang support of Che suggested solut~.oz~s set out by ~he Chamber of Commerce to endeavor to resolve the medical malprac~ice problem, which reads as follot,rs: A. Arbitration must be mandatory at a local level. 1. If gross negligence is involved the ~laintiff ' ~may sue 2. Gross negligence wiZl be defined by law 3. Th.e arbitration pan.el to be selected by lot, similar to present grand jury ~. Establ~.sh a ~egressive contingency =ee: C. Establish a fixed schedule of payment for non-econo~nic losses, economic recovery can be determined: D. Cost o~ medical care and economic loss should be paid monthly or bi-monthly. E. The State Medical Examiaers Board sh.ould be given the resources to enforce goo~. medical practices anc~ to discipline viola~ars. ' , ~'. Require insurance companies to report detailed ~nformation to the State ~nsurance Commission regarding the basis for establishing malpractice premiums and seek legislativa ' action restricting their investments to the Prudent Man P~u1e .
