October WIiEREAS, on £e~p~e~r 7, 1975, the County Surveyor-Bireetor of Public Works of this County presented to this Board a boundary map entitled "Sacramento Avenue Assessment District No. 1" and'' said map showed a boundary line enclosing an area in this County; and October WHEI.ZEAS, on ~ept~er 7, 1975, this Board adopted its' Reso7.uta.on I3o. 75..~44 and therein approved said map, and thereiri ` gran.ted the name "Sacramento Avenue Assessment bist~ict No. 1."'to the area in this County,shawn enclosed by said boundary line on °. said map, and WHEREAS, this Board desires to construct work and improvemerits benefiting said assessment district and desires to acguire all:rights of way, places and properties necessary for constructing said work and improve~nents a11 under a lawful declaration that the public '. convenience and necessity require the same, and WHEREAS, ~his Board desires to assess all of the costs and ~ expenses of said work and improvements and the cost of any acquisi- tions necessary therefor on the District of lands mentioned herein- above, to wit, said Sacramento Avenue Assessment District No. 1:= 1~OW, TIiEREE'ORE, i RESOL~lED BY 'THE BOARD OF SUPERVISORS dF THE COUNTY OF B[3TTE: 1. That a map of said Sacra~ento Avenue` Assessment District No. 1 is on file in the office of the Clerk ' of this Board and this Board hereby refers all persons to said'; map for a showing of ~he location and extent of said Sacramentq i Avenue Assessment District No. 1. 2. That thzs Board hereby preliminarily determines to pay ~ for the cos~ of all of said work, said improvements and said acquisitions and all expenses appertaining thereto by levying ", special assessments on the lands situate within the boundaries'of said Sacramento:Avenue.Assessment:bistriat No. I saving; and excepting therefrom the area of all public streets and also prelimi- na~ily determines to a,5•sess the same in accordance with the bene~ fits that each parcel of land in said district receives thexefrom. ;t. ~ 3.. That this Board hereby preliminarily determines tp dp'tlie work, ~o construct the improvements and any lawful changes thereto, and to acquire the rights of way, piaces, and properties and any, law~ul additions or deletions thereto all under proceedings tha~' this Board sha11 conduct for the same under the ~mprovement Act of Z911 and this Board hereby preliminarily de~termines to undertake said proceedings under said Improvement Act of ].911 without comply- ing with the provisions of the Special Assessment Investigation,:. Limitation and Majority Protest Act of 1931. 4. That on date hereof the County Surveyor-Director ot Fublic works has presented no plans or specifications to this Board show- ing the nature and locations of said work and improvements. That in the cou~se of ~he prbceedings that this Board propases to conduct under said Improvement Act of 1911 this Board wi~l adopt and approve plans and specifiaations showing the nature and loca- tion of said work and improvements and showing the location ofi` ' ail rights of way, places and properties necessary to be acquired for constructing the same and will adopt and approve an Engineer's estimate showing the estimated cost of a11 work and zmprovements~ and acquisitions, and that this Board will cause each person owning land in said Saeramento Avenue Assessment District No. 1~ that is subject to assessment to receive notice of the a~option .' af said p~ans and spe.cifications and said cost estimate together with a sta~ement of his rights under said Zmprovement Act of 1911 to protes~ to the same. 5. That this Board hereby sets Nouemberl8 , ~975, at' the hour ofl:30 o'alock p.m. at the Butte County Adminis~ration Building, Oroville, California, as the time and place for a public hearing whereat any person interested may appear and show cause why this Board should not tind and determine that the public convenience and necessity require the County o£ Butte to do said work and construct said improvements and to acqnire said rights of way, places and properties a11 without complying with the~ provisions of the Special Assessment, Investigation, Limitation ' and Majority P~otest Act of 1931. 6. That this Bqard hereby directs the Clerk of this Board to notify all interested persons of said hearing by doing all of the following: a) Publish a notie~ in the newspaper of genera~ ci~cula- tion known as the Chico Enterprise Record and publ~sh said not~ce in two entire issues of said newspaper, one of which shall be published on one day and the othez shall be published on a day subsequent to the day the first notice is published and publish ~' _ _ _ .. ... __ __._ '! ~ . ~ _ , I said notice for the first time at least IO days before the date hereinabove set for said hearing; b) Mail prepaid at least 15 days before the date herein- above set for said hearing a notice to each owner of land within the proposed Sacramento.Avenue Assessment District No. 1 whose name and address is shown on the equalized assessment roll of the County of Bu~te last prior to the date of this resolut~on and mail such a notice to the owner of any said land whose name and whose address the C1erk knows and mail such a notice to the owner of any said land whose land is assessed under the provisions of ~ Section lg Artic~e XIII` of the Constitution of California at the ~ address for said owner shown on the Board ro1Z last transmittea to the County Auditor prior to the date of this resolution. 7. That the County Surveyor~Direator of Public Works shall; post notices on a11 open streets within the boundaries of the " proposed Sacramento Avenue Assessment District No. 1 at not mo~e' than 300 feet in distance apart but not less than 3 said notices' ~ on each said street and shall complete posting all said notices ' at least 10 days prior to the date set,herein for said public '+ 3 hearing and said notices so posted sha11 be headed Notice of Improvement set in type not less than one inch in heigh~. ~ 8.
