A proposal tor-_:the_~orm~~.ion of the Lake Madrone Water
Company, having cbzne on ~or:hearing pursuant to Water Code
Section 34168, and;
Prior thereto,, a bond as required by Water Code Section
34167 ~.n the amount of $~.,000 having been filed and accepted; and
Notice having been publishecl and given as specified in
Water Code Section 34180 through the Oroville Mercury Register,
a newspaper of general circulation wzthin the County of Butte,
State o~ California; and ,
Petitions having been previously filed with the Board of
Supervisors and having been certi£ied by the Clerk of such
Board, as representing more than ~ifty percent of the area proposed
to be served, and incZuded within suclz California Water District;
and
The time and place of hearing of the Petitiori for Formation
of such water distric~ having been set for Octaber 7, 1975, at
1;30 p.m, in the Board of Supervisor's Room, County Administration
Bnilding, Oroville, California; and
P~~.or to commencement of such hearing, protests to the farma-
tion of such District having been filed by the certain landowners,
representing the certain identified parcels within the boundaries
of' the proposed District; and
The presentation of the proponents and opponents to the
formation o~ such District and of those parties seeking to have
excluded from the boundaries of ~hose districts, certain lands
all having been heard and considerPd:
NOW, 'I'HEREFORE, on motion o~ McKillop ,
seconded by Cameron , and unanimously adopted it
was resolved by ~he Board of Supervisors, County of Butte, State
of California as fol~ows:
I. The Lake Madrone.Water District, a California Water '
Dis~.rict be formed and existing under Division 13 of the Water
Code of ~he State of California sk~a~.l be placed to the elec~orate,
at the tizne and place for normal election in March of 1976 in
accordance wa.th Division 13 of the Water Code of the State of
California and all applicable laws of the State of California;
2. '~hat the following described lands shall be excluded
fzom the boundaries of the District upon the following conditions,
and only if such aonclitio.n.s are met within 45 days from the date
of this resplution:
(1) Myron M. Nelson and Minnie 0... Nelson, his wife,
as owners of that certain real prope~ty described and attached
hereto as Exhibi~. A, and
(2) Paul A. Menke, as to that real property described
and attached hereto as Exhibit B, and
(3) Thomas R. Lind~oot, Annette Lindfoot, Arthur
Lindfoot and Arthur W. Linclfoot, together as to that real property
described and attached hereto as ~xhibit C, sha11 waive and give
up, as to the real property owned by them any and all rights to
u~i~:ize ~he,lake known-as-Laker.'Madro~e';Qr::,any:,beaches, common
areas, meadow areas or boating facilities associated with such
Zake and do further wa.~ve as to such real property described in
Exhibita A, B and C hereto, any righ.t to ob~ain raa~.er from any
system of the Lake Ntadrone Water Company, a public utility comm-
ission.regulated:`water company and shail deliver recordable docu-
ments to such effect to the proponents of District for the purposes
of recordation.

3. That the following described lands shall be excluded
from the boundaries of the District upon the following conditions
and only if such conditions are met within 45 days from the date
of.this resolution:
Tha~ Harrie~ K. Toftner as to that certain real property
described and attached hereto as Exhibit D and Myron M. Nelson
and Minnie O. Nelson, his wife, as to that real property, described
and attached hereto as Exhibit E, do execute and deliver to the

proponents an agreement in recordable form, waiving and giving
up as ta themselves and as to the real property :any:rig~ts
existing and arising to use the lake known as Lake Madrone, the
beach areas, common areas, meadow areas adjacent to the lake and
any boating facilities associated with such lake but ~eserving
to such lands described the rights<:andr-privileges,;:whatever~_they
may be, existing on the date of this resolution and obtain service
from the Lake Madrone Water Company or any successor owner of
such water system.
4. That the name of the proposed California Water Distriat
shall be the "Lake Madrone Water District".
5. That the petitions he'retofore submitted and certified
by the Clerk of this Boa~d, are genuine and sufficient, and that
such petitions represenf. no less than 360.1 acres within the total
area;~s~roposed to be formed by ~he District prior to exclusion.
6. That at such election held along urith such other
elections as may be held in March of 1976, there shall be
submit,ted to the electorate within such proposed District tlze
following issues:
(a) Whether or not the Distric-~ should be formed; and

(b) If such District is to be formed, candidates
for the election of persons to fulfill the offices of the proposed
DzstriCt.

Chairman Ladd; Noes: None; Absent: None.
