~ BE IT RESOLVED by the BOARD 0~' SLTPERVISORS of the County of Butte~
~ State of Calif'ornia, that said Board finds and determines and hereby declar;es~
~ as follows, to wit: ~
8 1. '~hat public interest and necessity re~uare the acquisit~on`by the
7 County.of Butte, of said easement for the relocation. o~ electrie transmissi'on
$ lines, in the County of Butte, Sta~e of Califorxiia.
9 2. That public interest and necesszty xequire the acquieition of
10 said utility easement, hereinafter described, and it is hereby found and';de3ter--
1~- mined ~hat the construction o~ axx electric transmi5sion Iine is a public us?e,
12 autllor~zed by law~ and that public in~erest and necessity require the cons~ruc-
~3 tion of said improvements and the acquisition of said easement hereinafter`'
14 described.
15 3, Said propose@ public improvement is planned and located in a
~8 mann.er whieh will be most compatible with the greatest publ.ic good and the least
~'~ private znjuxy.
~8 q. ~hat the County Counsel of the County o~ Butte is hereby aut;ho-~
~ ig rized and empowered as follows:
20 (a) To acquire, in the name of the County of Butte, a uta.l.ity ease-
21 ment by condeznnation in accordance with the provisions of the Streets and High-
22 ways Code, Code of Civil Procedure and the Constitution of the State o~ Califor
2~ nia~ relating to eminent domain, to authorize the Auditor to pay from County

funds the costs and considera~ion for s.aid acquisition, and the Auditor ~.s

authorized to make such payment on authorization.

(b} Ta prepare and prosecute for the County o~ Butte such proceed-
ings in the proper court having jusisdiction thereo£, and make such deposits
from County t'unds for ~ees and costs as are necessary ~or such acquisition.
~c~ To rnake application to said court for an ord.er fixing tlie '
amount of security in the way o~ moneys deposited as said cou.rt may direct, an
for an, drder permitting ~the County of Butte to take immediate possession and
use of said easement for an electric transmission 7.ine ~or public use.
(d} To make deposit of such security out of proper funds under the
control of the County of Butte, in such amounts as fixed and dete~~wined,:and in
such manner as said court.in which condemnation proceedings are pending,may
direct, an,d the Auditor is authorized to make saa.d deposit immediately upon th,
court making said order.
5• The said easement which ~he Coun-ty of ~utte is, by this Resolu-
tion, authorized to acquire for said elec~ric transmi.ssion line, is situate in
the Countyup~ Butte, State of California, more particularly described in E~chib'
"A", attaehed hereto and made a part hereof by reference.

A utility easement wa.th the right to ereet, constru.ct, reconstruct, replace,:
remove, maa.ntain~ and use a line of pol.es with such wires as second party shall.
from time to time suspend therefrom for the tran.srnission of electric energy,
and Yox communication purposes, and a11 necessaxy and proper crossarms~ guys,
anchors, and o-~her appliances and fix~uxes for use in cortnection with said poles
and wires, together with a right of way~ on~ along, and. in all of the hereinafter
described sGrip o~ those certain lands which are situate in -~he County of Butte~
State of California, and are described as follows:

The parcel of land described in the deed from Robert B~.ade and Bijou "
E. B1ade to Robert E. Tabacchi and wife dated June 15, 1960, and
recorded July 6, 1960 in Book 1065 of Official Records at page 590,
Butte Covnty Records, an.d being a portion of the east half of Section
25, Township 19 North, Range 3 East, M. D. B. & M.
The aforesaid strip is described as foll.ows:
A strip of land of the uniform width of 15 ~eet lying contiguous to
and southerly of the northerly boundary line of said lands and extend-
ing from the easterly boundary lzne of said lands westerl.y approximately
260 feet to the westerly boundary line of said lands.
