HomeMy WebLinkAbout75-158RESOLUTION AMENDTNG RESOLUTION N0. 62-5 (RULES AND PROCEDURES FOR THE ADMINISTRATION OF A MERTT SYSTEM WHEREAS, this Board has determined that the ' effectiveness of the classified service will be promoted if certain sections of Resolution 62-5 are amended, NOW, THEREFORE, BE IT RESOLVED that: 1. Section 6.15 is hereby amended to read as follows: Section 6.15 OVERTIME. The following provisions ' shall apply to overtime work: a. Policy. It is the policy of the Board of Supervisors that overtime work is discouraged; that each department head arrange the work of his department so that fu11-time employees shall normally work not more than normal departmental work week; ~hat overtime work be held to a minimum consis~en~ wi~h ~he efficient performanc~ of necessary functions; and that overtime work be used only for emergencies or when temporarily using regular employees on an overtime basis can be shown to be more economical than by using extra help. It is recognized that occasional overtime work may be necessary, and that zn such instances provisions should be made to authorize, keep records, and compensate for such necessary overtime work. 7 ,s'--/ J~8` b. Work Period. The normal work period shall commence 12:01 A.M. each Saturday. Each full time empZoyee shall work 37 1/2 hours per week unless the Board of Supervisors pursuant to Section 9.6 of these rules establish a longer work week for a particular employee or group of employees. In such case, the work week shall not exeeed 40 hours. c. Authorization of Overtime Work. Overt~me work sha11 be performed only upon authorization of the department head or subardYnate empowered by.him to authorize the same. d. Overtime Defined. pvertime is authorized overtime o~ at least 12 minutes oceurring at the beginning or end of the work shift or authorized call back time. e. Records of Overtime Work and Justificatzon. Each department head sha~~ keep an accurate record of all authorized overtime including the actual overtime hours worked by the individual employee together with justi~zcation for i~s authorization in each case. f. Reporting Overtime. Total hours o~ authorized over~ime ~or each pay period for each emp~ayee shall be reported on the payroll preZzst to the Auditor. g. Overtime Pay. Overtime in excess of 37 1/2 hours per week shall be paid a~ the employees' current straight applicable rate. Overtime in excess of 40 hours per week shal~ be paid pursuant .to the applicable provision of the ~ederal Fair Labor Standards Act. -2- h. Fringe Benefits not Affected by Overtime. Overtime work shall no~ be a basis for increasing vacatyon or sick leave benefits, nor shall ~t be a basis of advancing completion of required periods for probation or salary step advance. i. Overtime for Ca11-Back. An employee who is required ~o return to work on an overtime basis shall receive a minimum credi~ for two hours work. j. Exemp~ Employees. The overtime provisions specified ~n this section do not apply to county o~f~ce~s, department heads or those empZoyees in classifications exempt~d from paid overtime by the Board of Superv~sors. 2. Section 6.16 is hereby amended to read as follows: Sec~ion 6.16 PAY DT~FERENTIALS. When i~ has been determined that an employee's use of bi-lingua~ language skills or specialized communicatio.n skills are essential and critical for the successful performance of the functions of a county department, the employee shall receive a pay differen~ial of $y.15 per day of compensated service. ~he Personnel Director shall formulate policies and procedures for admznistering the provisions of this section which shall require the written justif~cation by the department head, verification of the employee's language or communication skill abil~ty, and procedures for revi~ew of continued need on no less than an annual basis. 3. Section 6.17 zs hereby amended tio read as follows: Section 6.17 SHZ~~ DIFFER~NTIAL as pertain~ng to the County Hospital is deleted in its entirety. -3- 4. Section 9.2 is hereby amended to read as follows: Section 9.2 SICK LEA~E. Regular and limited ~erm employees shalZ earn sick leave at a rate of 0.04b2 days for eac~ day of compensated employment. Unused sick leave may be accumulated without ~imztation during a continuous period of employmenti. Regular part-time employees and lim~ted term employees sha11 earn sick leave on a pro-rated basis. Extra help employees shall not earn sick leave. Sick leave shall not be considered a p~ivilege which an empZoyee may use at his discretzon. It shali b~ allowed only in case of necessity for actual sickness or disability. ~n order to receive compensation while absent on sick leave, the employee shall notify his department head prior to or within (4} four hours after the t~me set for the beginning of his work shift. The employee shall upon request file a physician's certificate with the department head stating the cause of his absence and his physical abili~y to return to work. Sick leave time shall be eharged against the employee's accrual in accordance with the number of days allowed. Upon retiremen~ or termination in good standing an employee who has on accrual more than (30) thirty days of sick leave may be compensated for that portion over {30) thirty days at (1/2) one-half his normal rate of pay up ~o a maximum of ($1000) one thousand dollars. -~- 5. Sectxon 9.6 is hereby amended to ~ead as Follows: Section 9.6 HOURS OF WORK The normal work period for each ~ull time county employee shall be 37 1/2 hours per week unless the Board of Supervisors have by resolu~ion established a longer normal work per~od for an employee or group of employees. Department heads sha~~ schedule the employees' hours in such a manner as to maintain county offices open ~or buszness contixnuously from 8:30 a.m. to 5:00 p.m. each day of the year except Saturdays, Sundays and Holidays. Departments which necessitate a different daily operation schedule shall maintain and post an employee assignment schedule. No employee shall, except in the case of emergency, be required to work a different schedu~e ~han ass~gned unless the employee has been notified at least ten (10) calendar days in advance of t~e change in the wo~k schedule. ~mployees may be allowed rest period of 15 (f~fteen) minutes during the mid-portion of the first and second half of a shift. Rest periods shall be scheduled in accordance with the requirements of the department, but in no case shall rest periods be scheduied within one (1) hour of the beginning or ending of a work shift or lunch period. The depar~men~ may designate ~he time and location or locations at which res~ periods may be taken. Rest periods shall be considered hours worked and employe~s may be required to perform duties, if necessary. -5- 6. Sec~zon 9.8 is hereby amended to read as follows: Sect~on 9.8 HOLIDAYS Each regular or limited term employee in a compensa~ed emp~oyment status on his assigned work day immediately precedxng and his asszgned work day immediately fo~lowing a designated holiday shall be en~i~~ed to compensation for the designated holiflay. The following holidays are designa~ed: a) New Year's Day January 1 b) Lincoln's Birthday February 12 c) Washington's Birthday Third Monday ~n February d) Memorial Day Last Monday in May e) Independence Day July 4 f} Labor Day First Monday in Septembe g} Admissions Day September 9 ~} Veterans Day November 11 i) Thanksgiving Designa~ed Thursday in November j} Christmas Day December 25 k} Every day appointed by the President or Governo~ for a public fast, thanksgiving, or holiday. In addition to the designated holidays each regular employee shall be entitled up to three personal holidays per calendar year. Regular employees employed as of January 1 of each year shall be credited with three (3) work days of personal holiday. Employees hired between January 1 and Apri~ 30 sha11 be credited wi~h ~wo (2) work days personal holiday for the rema~nder of ~he calendar year. Employees hired be~ween May ~ and Augus~ 3Z shall be credi~ed with one work day of personal holiday for the remainder of the calendar year. Employees hired between September 1 and December 31 shall receive no personal holiday credits for the year during which they were hired. A department head may require an employee to provide fourteen (14) calendar days notzce in advance oF the per-sonal holiday. In the event o~ an emergency -6- a depar~ment head may deny the employee's personal holiday. Personal holidays shall be scheduled and taken off within the calendar year to which ~hey are credited. Employees shaZl not be compensated in pay for personal holidays in lieu of t~me off. When a designated holiday falls on Sunday, the following Monday sha11 be observed. When Veterans' Day fa11s on Saturday, the preced~ng Friday sha11 be observed. A regular or limited term employee requzred to work on a designated holiday or whase regularly scheduled day off falls on a designated holiday shaZl at the discre~ion of his department head be entitl~d to ei~her equivalent compensated time off scheduled the day pr~ceding the designated holzday or within sixty (60) calendar days following the designated holiday or equivalent compensation to be paid within sixty (60) calendar days following the designated holiday. Regular employees exempt from paid overtime shall be entitled to compensation for designated holidays actually worked. Extra help employees sha~~ not be entitled ~o paid holidays or compensated time off for holzdays worked. 7. Sectzon 9.9 is hereby amended to read as follows: Section 9.9 JURY AND WITNESS LEAVES Employees shall notify their department head immediately upon receiving notice of jury duty or call as a witness. Regular or limited term employees who served on a jury or is served with a subpoena whieh compels their presence as a wi~ness, unless they are a party to the court action or an expert witness, -7- _ _ _ _ ~- _ . __ ~ j - _ . - . _ , ,; shall be granted a leave of absence with pay in the amount o~ the dz~fe~ence between the employee's regular earnings and the amoun~ recexved for such appearances. ~mployees called for such court appearances may retain the court paxd mx~eage fees provxded t~ey did not use a county vehicle or claim county mileage for such appea~ance. If called to jury or witiness servxce, a reguZar employee may elect to: a. Recexve tihe jury or w~tness fee and also full salary payments chargeable ta personal holiday or vacation time. b. Receive the jury or witness fee and certxfy to the County Auditor the jury or witness service and recezve the paid leave differential. Regular or limited term employees called to jury duty or as a witness during norm~l workxng hou~s are in each instance required to collec;t: fees for such servzce and to advise ~heir department head. 8. Section lI, 11.1, and 11.2 are hereby added as follows: Section 11 EMPLOYEE SAFETY 8ection ll.l Safety Committee. The Board of Supervisors shall by resolution establish a county safety committee. The resolution shall set forth the purpose, objective, plan and establish the responsibility for carrying out the safety program. -8- Section 11.2 SAFETY EQUIPMENT CQST DIFFERENTTA~ PLAN Safety equipment required to be provided by the county to insure an employee's safety workin~ conflit~ons may, for the equipment specified in this sec~ion, be purchased by the employee at cost to the county. a. Safety Lenses. Employees whose job duties require that they wear safe~y lenses, shall upon request and certification of cost be paid the differential between sa~ety lenses and the non-safety lenses when such employee is required to wear prescription lenses. b. Law enforcement officers requzred to be provided a handgun as necessary sa~ety equipment to perform their normal duties shall be issued a standardized handgun or be permitted to purehase a persona~ handgun of a type and caliber approved by the departmen~ head and receiye a reimbursable cash adyance in the amount of the value of the standardized depar~mental handgun. At the time such emp~oyee terminates or becomes ineligibZe to be issued a standardized county handgun, the emp~oyee shall reimburse the county in the amount of the cash advanee. The County Auditor shall maintain the reimbursement records.
