The Board of Supervisors of the County of Butte, State of California do ordain as follows: SECTION I A rider and hikers trail as used in this Ordinance is hereby defined to mean and refer to A. Any trail heretofore established pursuant to Article 6, Chapter 1, Division 5 of the Public Resources Code (Section 5070 et se q) and which trail has been posted with the officially adopted riding and hiking trail signs; and B. Said rider and hikers trails within the County of Butte which have been heretofore designated pursuant to the Public Resources Code are commonly known and referred to as the 71Master -Loop Trail', a portion of which~~is in Butte County, and the Y'droville-Feather Falls Secondary Trail=', all of which is in Butte County. SECTION II It shall be unlawful for any person to operate any motorcycle, power cycle or other motor vehicle on any rider and hikers trail within the County of Butte other than a vehicle used for an emergency or maintenance purposes, unless the trail traverses a common right of way. SECTION III It shall be unlawful for any person or persons to remove, destroy, or change the location of any of the officially designated rider and hikers trails signs which have been used to identify said trails, or to use said signs or any other signs similar to said officially designated rider and hikers trails signs and identify or designate any other trail than those hereinabove set forth, and described as the official rider and hikers trails existing in Butte County. -1- 7SFr SECTION Iv This Ordinance shall be effee~ive only to those portions of the. YeMaster-Loop Trail" and the ~'Oroville-Feather Falls Secondary Trail' which the State of California has, through its Division of Parks and Beaches acquired easements, rights of way, licenses or fee interest, pursuant to the Public Resources Code, and shall in no way be construed to be operative upon private property or to restrict any individuals use of private property. SECTION V Any violation of Section II or Section III of this Ordinance is a misdemeanor punishable by a fine of not more than ONE HUNDRED DO~,hARS(~100.00) or by imprisonment in the County Jail for not more than THIRTY (30) DAYS, or by both such fine and imprisonment. _ SECTION VI This Ordinance shall take effect and be in force thirty (30) days from and after its passage, and before the expiration of fifteen (15} days after such passage this Ordinance shall. be published once .. in the oroviile Mercury , a newspaper of general circulation, published in the County of Butte, .State of California, together with the names of the members of the Board of Supervisors voting for .and against the same.
