HomeMy WebLinkAbout76-001WdEREAS, during the past few years there has been a sub- s~antial erosi.on o~ the independent authority of 1oca1 air pollution control dist~~.cts over stationary sources by the intrusion and usurpti.on o~' such authority by Federal and State agencies and this, tlie suggested New Souxce Review Regulations, is a recent example; an.d C~IHEREAS, the use of phraseology utilizing "suggested reguZations" for regula~ions which are intended to be and are forcad into law by adu~inistrative code through intermediate agencies is misleading as to public effect, and circuitous as to procedure; and Wt3EREAS, local air pollution control d.istricts are already bound to regulation o£ emissions which. consider attainment of air quality seandards and the suggested reguZation in ~act sets a signi- ficance level of emissi.ans which would prohibit new sources in any area al.ready exceeding standards but the responsibility for implementing the established restriction would be passed to local air pollution contro~ di.stricts; and W~-IEREAS, there are a number of other Federal and State require- men~s or programs as welJ. as ~.ocal pxograms which have similar objectives and actions; and WHERE,A.S, the specific requirements for final State ARB validation on any Authoxa.ty to Construct or Permit to Operate issued under the provisions of the "suggested xeguiatzons" a.ncreases and dupl~.cates procedures, resources and bureacracy wi~hout corresponding benefit and this pro~rision was added without adequate chance for review and comm.ent by the Iocal azr pollution control di.stxicts, and this provision is ta~c~.tamount to State authox~~.ty ove~ evezy acti.on on. permits by the local distxicts; and RESOLUTION BY TH~ BUTTE COUNTY AIR POLLUTTON CONTROL DISTRICT CONC~RNZNG STATE ARB SUGGESTED NEW SOURCE REVIEW REGUT,ATTQNS WHEREAS, the additional resources needed by local dis~ricts to coordinate and effec~ such a permit program is being mandated at a time when State support o~ local programs is being decreased; NOW, `TH~REFORE, BE IT RESOLVED by the Butte County Board of Supervisors, sitting as the Butte County Aix Pollutiox~ Control District Board, as ~ollows: 1. That this Board respectfully and strongly opposes the proposed regulations as presented; and ' 2. This this resolution be directed to the Chairman of the Air Resources Board, t~ie Governor of California, me~nbers of the State Legislature, Basin Coordinating Councils in the State and air pollution control districts in the Basin.
